  • Qus about Visa for only one parent-in-law (only mother-in-law)

    Hi,

I have heard from couple of cases where if only mother-in-law went for visiter Visa, in those cases the person was given only 3 months visa.

I am going to sponser my wife's mom. Wife's dad doesn't want to come at this time and doesn't have passport yet. But we would like my mil to come for atleast 5 month. What should we do?

Background on her is that she should be able to show family ties back in India - Her son (married and has kid) is in India; working. Her mom and all her siblings are there and she doesn't have any intention on staying in US permanently.
If she goes alone for Visa then she has her husband also in India to go back to.
She does not have property on her name as it generally on husband's name in India. She has some bank account but not a lot of balance there.

Should my fil get his passport done and then both should go for visa (and then only mil comes here)

or should we take chance and just send mil for visa.

Which of the two options - she has a better chance of getting visa? Any advise is welcome. She would be going to Delhi counsulate.

    Thanks

Your inlaw's situation is very similar to my inlaws. My MIL got multiple entry on Dec 6th. My FIL is not interested in coming and he does not have a passport. MIL does not have any property in her name except for bank balance. The only diff is my husband sponsored her visa(his mother). He has 2 brothers living in India and he is the only one here.

She was not asked too many questions and even the ones asked were very simple. I guess it depends on the officer's mood and our luck mostly. I heard about rejections even when a single parent went for visa. Just cannot take anything for sure.

You might want to mention all the strong family ties your MIL has back home in the affidavit. We did the same but the affidavit was never asked. It is just as a back up incase asked for.

Good luck and hope this helps!

Thanks xoom75. Did your mil got "10 year multiple entry" or "shorter period multiple entry"? Where was her interview - Delhi or somewhere else?

I have another question for others - If my mil gets a 3 month visa and if we are lucky she gets I-94 for longer period (happened in some of the cases as people have mentioned on this site).... Until which date can she stay here; the one when her visa is expiring or the one on I-94?

This is a very helpful site.
      Thanks.
