I have a few questions regarding my mother’s visit extension in US. She came to US in Nov 2019 on B2 visa. Here are her full details:
Date of entry in US: Nov 26, 2019
I-94 Validity: May 25, 2020
1st extension – filed in 1st week of May 2020 with a request for extension until Sep 25, 2020. Reason: Pandemic and she being in high risk category due to being over 65. Decision still awaited.
2nd extension – filed in the first week of Sep 2020 with a request for extension until Jan 25, 2021. Decision still awaited.
Both the I539 extension cases still show "Case was received" with no further updates from USCIS.
Could you please help with following questions?
1. In the given situation, what consequences should we be aware of, incase extension 1 or 2 is denied.
2. Can we file for 3rd extension now, requesting for her extension until May 2021? We want to wait till she gets her vaccine, if possible.
3. Is overstaying, beyond the original I-94 date, by more than a year (in this extraordinary pandemic situation) going to cause any issues for her in the future?
