  • Inviting parents when host's visa is expired

    Hi,
I want to invite my parents to stay with us for a month. I am on H4 visa and my husband's visa is H1. Our visa(and I-94) is getting expired in the month of August.
Application for visa extension is already filed in June.

Will it be a problem if we want to invite parents in the last week of Aug on tourist visa ? My brother is going to show sponsorship for the trip and we are just going to show that they would stay with us. Which extra documents do we need to submit in that case.

Can our US based friend (on H1) send them invitation letter instead of us and show that they are going to stay with the friend.

    Thanks and Regards,
    Yogini

If you read these forums you will find that people find it difficult and challanging to get a VISA even when their own children invite them to visit the US, so how good do you think their chances if a friend invites them....

    I would say sure rejection.

Why do you not wait for your H1 to be approved rather than rush. Mostly what they are looking for it.

    1. The visitor has sufficient ties to return back to the home country.
    2. They have sufficient funds so that they do not become public charge.

If you provide all the documentation, they will not be rejected. Also try the avenue where they have a maximum potential to get a VISA. Once rejected its a herculian task to re apply and convince an office.

In your case it will look as though your parents are trying to find some sponsor and trying to get here by hook/crook.

So think clearly and do it right, do not rush.

      Hi,
      Thank you for your reply.
I am actually in a hurry to get my parent's visa stamped as I am travelling back to India for good in the month of Oct. Before I return back to India I want to show them nearby places.
So I am trying to think of as many legal options as possible.

Stick to the truth, send them whatever documents you can. They will qualify on their own. In fact since you are returning in Oct, it is good to show that they will return as well.
This is my opinion and not legal advice.
