B2 Visitor Visa - Parents

Hi All,

My parents obtained B2 visitor visa last in August 2009 with a 1-year validity.

Due to situations they could not travel to the US. They plan to travel this August.

My question is their visa will expire 10 days from their date of travel will they be granted admission to US ?

Please share your views, experience.....

No problem. They can enter the U.S. as long as the visa is valid. Once in the U.S, their stay is governed by the I-94 expiration date.

Okay got it that their stay will be governed by I-94 once the enter the USA but will they get an I-94 for 180 days from date of entry or will the I-94 date be same as the visa end date?

It all depends on the IO at POE. Based on the answers given by your parents, the IO will give his decesion in I 94. Normally a first time visitor gets 180 days stay. This case is slightly different.

As far as I know and from my 2 visits to the USA I-94 is only valid for 90 days. This is only 3 months from date of arrival. It is given to you on plane a small green card.
I think also you will find and correct me if I am wrong anyone, but if the tourist visa was for 12 months and was given last year August 2009 and is about to expire in 10 days August 2010 then they will have to leave in that 10 days or they should apply for another B2 visa. Or if they just want to stay for 90 days then a waiver visa can be done ESTA over the internet , See information on home page of this site or USCIS site.
