    Hello,
    My parents visitor visa was rejected for the first time on Oct 19th. The officer did not even look at thier documents. He just said I had not gone back to India for 2.5 years,hence 214(b)!!!!! I did not sleep for 4 months. I spoke to the senator in my state. He was very very nice. I read in some discussions in Immihelp that republicans do not support immigrants. That is totally wrong. The senator's assistant took all my papers on feb 07. She sent a letter to the consulate on feb 8th. It seems the US officers looked at all my docs 4 days before my parents interview which was on 17th feb. The senator did not give any recommendation. He just told the officer to look at my docs which were the same as the first time. Of course I made a trip to India otherwise there was no sense in my parents applying for the second time. This time my parents got a 1 yr visa.
    The point is:
    SENATOR'S LETTER DOES HELP
    Only if your docs are perfect. If there is a slight mistake in ur doc, you will lose the visa even before the interview.

    Sometimes ur docs are perfect,but the officer does not go thru it & rejects it. Senator's letter assures that they atleast take a good look at ur docs.

    For sake of people who have spent sleepless nights like me, I have to thank IMMIHELP as I did exactly as they said BUT

      search internet

      look up (( code of federal regulations title 22 section 41.11 ) it will revised as of april 1 ,2004 its not an appeal reg but may help others.

        That's intresting.. you mention that , you went to INDIA? what does that mean, what is the content of the senators letter , what else the quetions does senator asked to get the letter, did you showd them all the original documents..

          I had a similar situation with my mother. She is a widow and myself and my brother both are here in U.S. The first time her visa was rejected in December 2004 under Section 214(B). No documents were seen. Just 2 simple questions. After that I had called up the Ohio Senators office to request for an appoinment. They asked me what was the issue and I explained them my case. They asked me to fax them a letter explaining them the situation and giving all my mom's details. I did exactly what they asked me to. After a few days I received a letter via mail from the Senator's office which also had an attached copy of their communciation with the Mumbai Consulate. Basically, it jsut mentioned that they re-reviewed the case and even the supervisory officer agrees with the decision of the interviewing officer.

          After this we re-applied for her visa 2nd time in January 2005 and was rejected again unser section 214(B). Even this time 2 simple questions asked and not asked for any documents. Unfortunately, my mom has to take a translator and is not very good at communication and hence unable to convince the officer that she would return back to India.

          We all are really very disappointed and would really appreciate if you can help us by suggesting how differently I should have communicated with the Senator? How can they really help me as they were able to help your case? Also if you can give more details on your communication with the Senator. Any other suggestions also truely appreciated.

            Diffrent Situtaion, Mother and Parents

            I think , if your mother alone went for visa stamping , then that may be the reason, in other case parents went with the senator letter.. I guess that may be the reason of rejection even though you have submitted senators letter..

              The reason for rejection of my parent's visa the first time was that I had not gone back to India for 2.5-3 years. In order for my parents to apply again, I had to go back to India at least once to rectify the cause of rejection during the first time. I read the rules somewhere:
              If nothing has changed since the last rejection, it is likely to be rejected again

                I did nothing special. I just sent the same docs again. As I had mentioned, I think every thing was right with my docs the first time(not saying something is wrong with urs), they just looked at it in detail the second time & we got the visa.

                  For your case it looks like that you going to India and your communication with the Senator helped you. Can you Please give more details about your approach to the Senator? Can you Please suggest in what way can the senator help me? Should I try to meet him in person and ask him to help me?

                  regarding your point "If nothing has changed since the last rejection, it is likely to be rejected again" - Reason for Rejection for my mom's visa is Section 214(b) - potential immigrant. Other than preparing Affidavit document that lists her ties back home what else can I do to change the situation ?

                    in my case we were told the reason behind 214(b). I think cheena had a way to find out the actual reason from the embassy if you were not told. My Suggestion to everyone:
                    PL. DO NOT REAPPLY TILL YOU CORRECT THE CAUSE OF YOUR LAST REJECTION

                    This is my 2 cents.

                    Regarding Senator, As I have mentioned, I did nothing special. He did not ask me anything. I am sure his immigration assistant must have done a thorough background check before sending the letter.

                      I did not understand what you mentioned out here .

                      What papers did the Senator's assistant take from you ?

                      What letter was sent to the Consulate?

                      What docs did the US Officers look at before your parents were interviewed ?

                      Usually our parents carry the docs with them during the time of the interview.Did you send all the docs beforehand to the Consulate ?

                        I gave the senator an exact copy of the docs my parents were suppossed to take to the interview on 17th feb

                          I gather from your post that the Senator had passed on information to the Consulate in India regarding all the documents that your parents were carrying .

                          Some more questions :

                          You had mentioned that you went to India at the same time . How did that matter ? Did the stamping by the Indian immigration at the port of entry actually have any effect on the approval the second time your parents went or was it due to the letter that the Senator sent ?

                          Had you already appealed using forms G-28 & I-292 after their Visa was rejected ?

                          #My parents have been rejected the first time under 214(b) for no apprent reason even though they had all detail documents as mentioned on this site . I am on H1B visa and working in the US for the last 5 years and I had been to India last year .

                          Please share some comments on these questions

                            My mother was just given the reason for rejection as Section 214(B) and was not given a specific reason. Can you Please let me know how can I communcaite with the embassy to find out the specific reason so that I can fix it.

                            I would really appreciate a qucik response.

                              My parents visa got rejected on Feb. 22nd my husband is a sponsor as i am on h4 visa and we are thinking of approaching a sentor and get their help.
                              What docs. u consider are perfect?
                              I am very much concerned about their visa and we want to try second time with really strong case they have next appointment for April 4th.
