  • Passport validity for US Visitor Visa appointment

I have my US Visitor Visa appointment on March 8, 2023. I hold Indian Passport which expires on Sep 25, 2023. According to the guideline "The passport must be valid for at least six months beyond the period of stay in the United States", which means I still have six months and few days before the passport expires.

Will I get the Visa if I go for the interview with my current passport or do I need to get a new passport and then attend the interview ?

The passport should be valid for 6 months from the date you enter into USA. You are still good to get visa on your current passport, but its better to get a new passport before travel.

The rule basically means that when you enter the US, if you are admitted until a certain date, that date cannot be later than 6 months before your passport expires. That implies that you must enter more than 6 months before your passport expires (or you won't be able to be admitted to any days), and also means you cannot get a US nonimmigrant visa less than 6 months before your passport expires.

However, you have an Indian passport and India is part of the 6-month club, which means that you can be admitted until any date before the passport expires. This means that you can enter the US as long as your passport has not expired, and you can also get a US nonimmigrant visa any time before your passport expires.

This is my personal opinion and is not to be construed as legal advice.
