  • CR-1 Visa pre-marriage questions

    Hello all,

So I finally popped the question and asked my gf to marry me. Our next step is marriage. We are leaning towards the CR-1 visa so we would like to get married in her home country in the Philippines.

Everything seems pretty straightforward except my part where I need a document, proving that I am free and able to marry. The United States does not provide a document like this, and I’ve been seeing everywhere that people are getting affidavits notarized by the United States Embassy but the embassy page says that a regular notary is fine. I was hoping to get some clarity on this issue. As of 2024 do I need my affidavit notarized by the United States embassy, or can I go to any notary and have it notarized by them?

Another question, do both of us need to be present to submit the application for a marriage license? I’m asking because I want to know if I can leave the documents with my fiancé and have her submit the application closer to when we plan to get married later this year.

Even though we are both over 25 do we still need to attend the marriage seminar? I’ve read different things from different websites. And I was hoping someone was able to clarify this.
