  • Visiting non-home country between visits?

My in-laws who are Indian citizens are here in the US on a 10 year B1/B2 visa. They have been here for about 4 months now. Although their visa entry date is until January 15th, they are currently planning to visit Australia (where their son lives) for a month and come back here. Their planned dates are to leave to Australia in the first week of December and get back here around January 7th. (or first week of January). After that, they are hoping to stay here for 6 months.

I have seen cases where the stay validity extends by 6 months when B1/B2 visa holders visit the home country and get back? But, instead of home country, if they visit a third country would this still apply? Or, might it present any additional issues during immigration?

Does anyone here have any positive/negative experiences that they know of regarding this?

    Hello!
Reentering the U.S. on a B1/B2 visa after visiting a third country like Australia is allowed, but it doesn’t guarantee a new 6-month stay. Immigration officers assess each entry individually, and returning soon after a long stay may raise concerns. Strong ties to the home EZPassNC website country and clear travel intent help reduce the risk of denial.

      Hi,
Re-entering the US after a short trip may prompt questions from the CBP officer, as they are the ones who determine the I-94 validity. There is a possibility that they may grant a shorter stay than expected. Let’s hope everything goes smoothly.
      Thanks.
