Visitors Visa

Hello,

My husband wants to sponsor for the Visitors visa for his parents,but at present we have applied for visa extension as our visa is getting expired.Still we havent got the file number.Can we sponsor for visitors visa without I-797 form(as we dont have any right now)?

As long as the person is in legal status as the time of sponsoring, it is fine.
