    Me and my 3 daughters are currently on the visa waiver visa from Australia which expire next month. We all intend to stay here in the USA after my fiances divorce is final. My problem is that in order to extend our visas, we must have proof of our intension to go back to Australia (eg airline tickets) which we have not got as they went out of date last month. My fiances divorce will not be final for another 3 months and we have not got enough money to get tickets back to Australia (as we intended to get married before they expired). Now, because the divorce is taking longer than we expected, I am stuck as to knowing what to do. Do I stay here with the kids even if my stay here expires?? I would appreciate any advice on this matter please. when my fiances divorce is final, what if they won't let us get married because my visa has expired..........what then :-( Please help.

    If you came to US on visitor visa, only way to stay more legally is either to extend visitor visa or change to some other visa like student visa, employment visa (of course if you are studying or get job etc.)

    It does not matter what else is going on personally with you.

      Thanks for replying....another question for you :-)

      Can I apply for a green card while im in the USA on a visitors visa?? What type of greencards is there available? (other than employment ones). The reason Im asking is because I know that it takes a long time to get an employment one and you need a sponsor (employer) for that don't you?? I am a 2nd year nursing student who completed those 2 years in Australia. I intend to complete my degree but planned to do that after we were married. So....is there any other classifications for greencards here? Another thing I thought of was that my fiance sponsors me to stay here until we are married (not a fiance sponsor cos I dont think I can be in the country when he does that). What do you think????? Am I making any sense at all hahaha
