  • Visitor Visa Refused

    Hello,

I will very much appreciate if somebody can give me some guidance in the following matter.

Recently, my relative's visitor visa to US was denied by US Consulate's office in Mumbai, India.

During the interview, visa officer would ask a question to visa applicant but would not let finish the answer or allow enough time to complete the answer. He was rushing through the whole interview without listening to answer/answers of the applicant. He had made up his mind from the beginning to refuse the visa and was just reviewing or reading something on the computer and typing the information. His behavior was very unfair and unprofessional. He was conducting the interview for heck of it and wanted to get over with.

On the press release statements on Consulate's website dated November 21, 2011 says that the visa applicant will have a positive interview experience at their new facility. It also says that we are delighted to be able to serve our clientele in our new facility ....etc etc.

But the experience of my relative was quite opposite.

I was wondering is there any recourse or any steps could be taken against interviewer by notifying to the Consulate in Mumbai?

We respect the decision interviewer makes. We are also aware that the interviewer are well trained in their field. But the attitude, mentality and demeanor of the interviewer was inappropriate. People apply for visa and pay fees, so at least , they should be allowed to speak during interview. If interviewer did not want to listen to the answers of the applicant then what was the purpose of asking the questions and then not listening to the answers.

Other thing is, if this incident is brought to the attention of Consulate would that create a negative impact on visa applicant's records and jeopardize the future chance of getting visa approved ?

Anybody who has been through similar situation please share your experiences. Is there any way to notify somebody at the Consulate's office or to appropriate Government authority about interviewer's behavior and attitude?

IN THIS SITUATION WHAT SHOULD BE DONE ? WHAT IS THE RECOURSE?

    EARLIEST reply will be appreciated.

    Thanks.

It is not advisable to raise the issue. Visitor visa is issued at the discretion of the consular
and lodging a complaint will only have a negative impact on your future apps.
Many people are denied unfairly, including people of eminence.
The best recourse is to correct any weakness in the application and apply again after some time. A good thing is that you can apply any number of times. Many people succeed after several attempts.

        SAme experience on 12/23

        Hi people!

my parents had the same bad experience at mumbai with chinese looking visa officer and lousy interpreter who translated only half of the answers only, didnt let my dad finish the full answer and didnt look at the letter our lawyer prepared. My dad was coming for medical treatment and they were definitely going back since my brother is visiting them in february from UK. my grandpa lives with us and my mum takes care of lot of things in india. their visa was denied 2 years ago on my graduation for twice. Language has been biggest the barrier and they use lousy interpreters who are nothing more than just assistants who help people stay in the line and whatever. I cried my self almost to death. There was not a single thing that they were missing if only they just looked at the documents. My dad is govt employee.

I think the systems sucks!! Please let me know what should I do??

Yes, the system is not fully fair.
But we can learn from past experience and try to see how we can improve the next time.
Maybe next time they will get a better visa officer.

Can you post here the full interview your dad had?
Also, post your visa status in US and do you have other family in US

Please note that , documents do not carry much weight. How you answer the questions decides the outcome.

            Unfair visa procedure

            Hello, loveparents

Thank you for sharing your parents' recent experience at US Consulate's office in Mumbai.

My relative had also Chinese/Japanese looking visa interviewer. It is said that the outcome of the visa approval depends on the interview but, what if the interviewer does not allow time to complete the answer or listen to what the applicant is saying? What is the purpose of visa officer asking the question but doesn't want to listen to answer given by the applicant?

From what I have heard/read about other people's experiences is that the visa requirements are inconsistent and depends on the whims of visa interviewer.

One can not appeal on the given outcome of the visa interview, the only thing is to reapply and then again, it is not sure one will get the visa.

One person was denied visa for 4 times. While other person's visa was denied and within
15-20 days, person had reapplied and was granted visa. It is highly unlikely that the things/situation could have changed for the visa applicant within 15-20 days. But in this situation visa was granted.

My relative has not met his aunt and family in last ten years, but his visa to US was denied. He was well prepared with documents and everything else for the interview, he is well educated and had no need for a translator. But interviewer did not give him chance to answer or listen to him during interview and quickly ended the interview.

All my family members are very upset about the whole thing.

My support and best wishes to you and your parents.

If you want to share something more in this regard please do so.

            Take care.
