    Dear Sir/madam,

    My elder sister wants to visit USA along with her 4 year old son. I have sponsored my parents before and they got 10 years visitor visa for 6 months with multiple entry, but this time my younger sister and her Husband willing to sponsor visa for my elder sister and her son. So, my younger sis hired a visa counselor in India and she asked her to send documents mentioned under-

    DOCUMENTS FROM YOU (& spouse) AND Your Brother (& his spouse + children) - All should be copies -

    PASSPORT – Passport copy with ALL pages of booklet, particularly the all visa page
    Driving License or copy of ownership agreement or rent agreement of the house
    BANK ACCOUNT – Carry Bank Account Statement in USA for at least 6 months
    INCOME-TAX RETURNS – Please carry last 3 years Income-Tax returns
    EMPLOYMENT PROOF – Copy of Appointment Letter on Company’s Letterhead, Current Employment Status – your exact designation, current salary and exact duration you have been working with them, I-797 H1 Approval – Notice of Action (if applicable) ; Proof of any earlier H1 status that he must have held (if applicable) .
    Copies of earlier status in US - I-20; copy of Degree certificate ; proof OPT positions that he may have held on a F1 status (if applicable).

    I have some confusions regarding these docs:

    1. As per my understanding above docs needed only from sponsor , in this case i am not the sponsor then why she asked for my all docs ? I believe she needs all this docs only from my brother in law.

    2. I never heard or read that immigration officer asks for copy of relative's or sponsor's social security cards during visa interview( plus sponsor's income tax returns always has SSN on it if needed) then why she asked for everybody's social security cards? when my younger sis asked this question to visa agent via email then she replied-

    Q- from my younger sis to visa agent-Does anything need to be specifically provided for my brother outside of the list above given that he has kids, or is the list above sufficient for him too?Also, for Accommodation proof - are all those items you listed required, or just one (or the more the better)? The Social Security Number - can you explain how having that information helps during the visa interview?

    Ans- from visa agent to my younger sis-In addition to the list provided, your brother can provide passport copies of his kids.Regarding the accommodation / proof of stay in USA... preferably ALL documents.The copy of the SSN will be with the applicant only... just in case the visa officer questions about it or asks if the applicant has the relevant document then she can provide the same... She doesn't have to remember any numbers.... it's just a copy of the document in her file & only if required by the visa officer then she takes it out.

    3. Above answer sounds little fishy to me because in my kids passports, there is no address. in American passports, I do not think that they mention address because my kids are American citizens. Plus SSN card does not contain any address either. Moreover, My self, my spouse and my younger sis are permanent residents and my brother in law is citizen who is the only one and main sponsor for this visa. then why she asked for everybody's i-20, EAD, passports and all other docs to prove legal status and relation. I think she just need my younger sis's copy of green card, passport and birth certificate along with her marriage proof with my brother in law and all sponsor docs from my brother in law.

    4. I have done lots of research and reading before for visitor visa and other visa process and/or required docs for visas when i sponsored my parents and when i did my and my spouse's entire immigration process. but No websites and /or visa agents asked for sponsor's or sibling's spouses and kid's docs. only when somebody is sponsoring any in law's side relative then they need spouse's birth certificates and passport to just prove blood relation with visa applicant.

    5.Visa agent says that all types of doc needed form all immediate relatives- but according to USA immigration law-§201(b) of the Immigration and Nationality Act ("INA") defines "immediate relatives" to include:
    1. spouses,
    2. minor children (under the age of twenty-one), and
    3. parents of U.S. citizens (if the citizens are at least 21 years old)

    AS per above definition- Siblings are not even subject to consider as an immediate relative. but suppose If visa agent is considering me as my elder sis's immediate relative, but how could she consider my spouse and kids as an immediate relatives to my elder sis? why she is forcing to give us unnecessary docs?

    6. In form DS- 160 for B1/b2 visitor visa under immediate relative column guidelines, they strictly guide -Immediate Relatives Means fiance/fiancee, spouse (husband/wife), child (son/daughter), or sibling (brother/sister). They directs to enter only name, surname, relative's status and relationship. they do not even allow to enter other relative's info other then mention above in their guidelines. once visa form DS-160 submitted then they send visa applicant a pdf. via email which mentions what docs to bring for visa interview and it states only sponsor's and visa applicant's docs.

    I do not mind to give any docs needed for my elder sis' visitors visa but I am little concern that this visa agent is lack of experience and lack of knowledge and I am not feeling comfortable to give her all immigration docs of my entire family which contains very personal info on it and which could be misused afterward.

    pl. guide me for my elder sis's visitor visa ( if I am not the sponsor), my, my spouse's and my kid's docs needed or not? if yes and then which docs needed? My younger sis is very concerned about this docs and she feels if we do not give my, my spouse and my kids docs to visa agent and after that my elder sis for her visa interview then she might get visa rejection. I do not believe it. so. I want a second opinion from some knowledgeable person. kindly provide me your suggestions.

    Yes, most of the documents that the agent said are not required. In fact,the decision is purely on the basis of the applicants' answers in the interview and documents are rarely looked at.

    If your elder sis in India has very good family income ,then I suggest they show self funding of the trip . That will increase her chances. In that case, the inviting sister can just send an invitation letter on her letter-head.( stating her resident status in US and that she is inviting her sister + kid for 2 months, and she will be providing them with full stay at her home) And she can send copies of her passport and Green card. No other documents required from sis in the US.

    If your sis in India cannot show self-financing, then in addition to the above,the sponsoring person needs to send an I -134 and financial documents supporting declaration on I-134.
