    The US consulate web site states that

    "If you have been to US earlier and applied for extension of stay, you must present a Form I-797 Extension of Status Approval Notice during your subsequent visa interview."

    When my mother visited me the last time, which was 10 years back - we did apply for an extension beyond the initial 6 months' visa, and got the extension for an additional 6 months. She left within that additional 6 month period - so everything was legal.

    She is planning to visit me again, but I may have lost this Extension of Status Approval Notice. Any experiences regarding whether the consulate officer asks for this document at the time of the interview, for applicants in a similar situation?

    They will ask for that document. If you don't have it, it may be difficult situation.

      if you are not having a Copy of extension visa...

      Here is my 2 cents. I have read it in MSNBC website recently that you can get a copy of that extension document from INS itself for some fee. I'm not very sure of this info. You can probably find it thru INS website or by calling them.

        I have also read that in newspapers online when someone's parents were detained at Los Angeles for 1 day and sent back to India.

        But unfortunately, I don't have any details regarding how to get it.

          here is how u get the duplicate approval

          ok here is how you can do it.
          you have to fill form I 824 for duplicate of approval. If you have the receipt that INS sent you that would be good as you will then have the WAC number and the process is straightforward. if you dont have the WAC number then see if you can trace the check you sent. At the back of the check you would have been required to write the I94 number. Trace the check and ask the bank to retrieve it from the microfiche. that will reveal the I94 number. then fill form I824 with either the WAC number or I94 number or both and submit it.
          hope this helps. Please confirm with lawyers too that this is the process. This is what i was told by uscis when i called them and i am just passing that info on to you. let me know how it went as i am in the same boat as you and praying!!

            what if visa extension was rejected?

            That's interesting.
            My parents did apply for extension when they last visited my uncle 20 years back. Their extension was not approved and they had to go back within specified time and they did leave USA within specified deadline i.e, they did not overstayed.
            Now do my parents have to present some sort of document which they received
            for their visa extension request.

              hello all,
              sprk seems to the point in describing the entire process , this is sumthing similar whaich i read in the news item regarding the indian parents detained in usa and deported back. better be careful with the the documents.
              for microdevu hardly have to produce those documents .

                they actually oversteayed

                Ok, it seems I have bit complicated situation in hand.
                Now I have come to know that my parents did stay beyond original departure date. When my parents got rejection letter, the letter had specified the date before which they had to leave. And they left before that date.
                It all happend 20 years back.
                Now what should I do? My parents says that they don't have rejection letter with them as it all happend 20 years back and they seem to have lost it.

                  different process for those who got extension rejected

                  ok. there is a change from my post giving instructions below:

                  just found out that if your extension is rejected you cannot request a duplicate by filing I824. i dont know how you get the duplicate of denial notice.
                  I 824 can only be applied for if you want a duplicate of aproval notice.
                  And if you have changed residence after filing extension, you also have to file form ar11 with the i824 application.

                    If they actually overstayed, I am not sure why anyone needs to get the denial notice. How is that going to help?

                      what is overstayed?

                      how do you define overstayed?
                      is it
                      1. if they applied for extension and waited for the usics letter of approval or denial, is that overstaying
                      2. if they applied for extension and left before receiving usics's response, is that overstaying(because they did not submit i94 at departure)
                      3. if their extension was denied and they left after receiving the letter (say within 2 weeks of receiving the letter)
                      4. or all 3
                      5. or none of the above

                      different people define it differently. can somebody throw some light on this?
