  • VISITOR B2 student queries!

    Hi Friends,
    Need an urgent suggestion/advice/pointers anything!!

I have my VISA(B2) interview scheduled this 22nd at KOLKATA consulate.
I have just graduated from college(BITS MESRA)and have got a job in PUNE w/ a joinin' date 0f 20th AUGUST.
My brother(we are twins!)also did his graduation and his heading to USC for his MS.
My MOM will also be interviewed w/ me but separately.
In my DS form I have filled in my sponsor as my father who is currently employed in COLOMBIA while my mom has mentioned self sponsored for her as she is currently employed with state government.
Now I know that I am not an ideal candidate for VISA as I am young, not employed technically and my Father is abroad, brother would be abroad and the only ties (financially)that my mother has is HER job and a house in her name.
Although I must mention that I have visited BOSNIA in the year 2006(didn't mention this on DS form)and have currently a COLOMBIAN VISA.

What are my chances of getting a VISA and any pointers to follow so that I build up a strong case!!

PS: Will My MOM's low income have any effect on getting her VISA(5.2 LAKH per annum)

Would likely help if you have plans to visit your dad in Colombia from the US.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

        pravat;

        Do I understand you correctly;
The purpose of your and your mother's visit is to to accompany your
bro to get him settled there in his MS course.

You should have posted before you took an appointment.
It is a weak case, I am sorry.

Officers look at the purpose and ties first, funding later.

        * the purpose is not concrete. So many students go alone to pursue
their MS and settle down without their family going with them.

*You are young, single, not settled in a job. Your mother has low income.
She cannot show self-funding on this income.
So weak financial ties for both of you.

*Most of your family is abroad, that is a big negative.
You are leaving no family ties behind.

1.Yes the main purpose is to see him settled well before classes start, though I can always say that we are going for tourism purposes to L.A .My mother has been to BOSNIA and COLOMBIA before so that should be a good enough reason to convince them that we wont be going to USA for anything other than Tourism.
(The actual reason is that my DAD's company is giving us our Ticket's money and some Money to stay anywhere in the world kind of LTA that will lapse if we do not take vacation by the end of september, though I wouldn't be mentioning this)

2.I know i should have posted before but everything happened so hastily that i didn't even had a chance to find that such wonderful forum exists.I know I am the only one to blame for that.

3.My mom has LOW income but she has a house in her name in Bhubaneswar(capital of ODISHA) and also a car.As far as I am concerned I will show that my DAD is sponsoring me for the entire trip.

4.Family ties do exists .Our grandparents(MOM's parents) live with us.They are old so while we will be in USA my MOM will ask my mausi(mom's sister) to come from DELHI and take care of grandparents.

          Thanks a lot!!

Another thing peace999 Technically my MOM's salary is 10 lakhs Per annum.
Due to a mistake by the govt. my mom was paid according to state level.
My MOM dragged the state government and the Higher Education Dept to court in 2008 and last year(June 2011) the judgement came which directed the state government to accord UGC status of PAY to my mom which is close to 10 lakhs per annum.
But as with all governments The state government(ODISHA) took a lot of time and hasn't yet given the UGC scale of pay for which my MOM has again dragged the GOVT to High court and the hearing is on 10th JULY.
So can my MOM say this to the VO.the original documents(High court order) can be shown as proof but i am afraid since the matter is subjudice will it have any negative effect.Apart from the House, car my mom has close to half a crore in her account as savings!!

            thanks in advance!

First of all, do not present your mother's pay dispute to the officer.
They are goind to decide in 10 minutes and will not listen to that detail.
And there are more imp. issues at the interview.

Like I explained to you in underscored statements why the case is weak.
Even if you guys have traveled abroad, your dad is sponsoring, the fact remains that
the officer will see the purpose as non-concrete and weak ties.( car , house, extended family do not count as ties) .
If you would have stayed back, you were a strong tie for your mother.

If the officer is good, your mother may get it because of her job . Make sure she takes the
                NOC from the govt.

1)Ok done won't ask MOM to show the pay dispute.(BTW My MOM and I have different interview and not same).
2)Since My Mom's Interview is before me at 9:30 am I will ask mom to say that I would be staying behind because of my job so I guess that establishes strong ties.
3)What if my MOM doesn't take the NOC!!

                  Thans a ton!

                    2. What will you do if your mother gets the visa? Will you not appear for the interview?
Because they will catch this lie if you appear for your interview.
                    Also, haven't you mentioned on
DS-160 that both of you are traveling together. Be careful what you or your mother says.
                    Do not contradict or misrepresent.

                    3. As far as I know all govt servants, NOC is mandatory. Double check with
                    VFS and US embassy website.
If it is, cancel the appointments and reschedule.

1.Ok got it I will mention that my mom will accompany me.I have written that in my DS 160 so won't retract.
                      2.Another Question though:
My brother has interview in the same consulate on the same day but at 9 am while mine is at 9:45.am
Nowhere has my brother mentioned my name.So If I say that my brother works/will start working in India (ERICSSON I will give proof for that--The company's joinin' letter) will the VO suspect anything cuz my brother hasn't yet rejected The company's offer. So i will show strong ties to India
If the VO asks Why my BRO isn't going to USA I can SAy that he has recently joined and hence the company won't give him a VAcation so soon.
Can they in any way know that my brother too has applied for US Visa(He's applied for F1 for COLUMBIA university)?

Reply please peace999 My VI is day after tomorrow!!

                      Thanks in advance!

Though am not helping, if you lie, the VO will know it instantly.
I hope you know, any false information in DS160 can lead to a life ban on entering into US.
Peace has given sane advice. Get your act together. If your brother is joining a uni he is going for an F1 Visa. I dont think y'all could have gone as a group anyway. If you are coming to US only to see him setlled, I dont know if there is a visa category for that at all. If you are applying as a tourist, I cannot see a single solid way you will spend your money in this country by means of tourism. So why should you be allowed in ?
Best of luck, and let us know how your ways worked out for you.
This is my opinion. Not a legal advice

1.I have given no false info in DS 160.I am asking that my brother has nowhere mentioned my name.(There were no questions in this regard in DS 160),so how will the VO know about my brother's F1 Visa.
2.Hello I have already paid my VISA MRV fee.So I have already contributed a little bit to USA's staggering Economy. This aside we were looking forward to visiting Universal Studios,Hollywood, the beaches etc in USA,So definitely a packet of Money goin' in smokes over there.
3.There is no SPECIAL Visa for going in a 3 group member. It's via B2.
Thanks for the Heads up though!! Appreciate it.

I never said you gave false info. I was just making you aware.

The problem is, there are a million Indians like you who want to contribute in this way. The exact reason why H1B visa fee was doubled. So what you have done is just paid the parking fee, whether you are allowed in the mall or no, we dont know yet.

Obviously, you are not aware that if family members are applying for a B2 visa they can appear for a group interview.

Today is EOD 6/22. How did it go ?

Yes Group Interview for Family is possible and I was aware of it but my and my brother's resident place was Jharkhand where we studied and my Mom's was ODISHA where she's working .When I had clicked to arrange for a family Visa, the computer automatically took my state of residence(the last 6 months) as ODISHA ..Hence I went for a separate interview.

Anyways My mom(10 years) and my brother(F1 5 years) got their VISA while I was rejected. My dad's VisaInter. is at the end of this month..Will post in detail after he goes through the process.
                              Thank y'all for helping.
