  • H-1 as sponsor

I read in one of the threads that visitor visa was rejected because the sponsor is a H1 holder. Is this true? I find it weird that a visitor visa is rejected stating the sponsor's status.
Of all the sponsor statuses, the H-1 is a temporary status and hence the visitor sponsored by him has a higher chance of returning back to the home country than any body else. Does my reasoning make sense?

    My thoughts on this topic:

Well...technically speaking the I-134 is only designed for U.S. Citizens and U.S permanent residents (as it is evident from the form...there is nothing to indicate other status). Consular officers can choose to reject a visa as seen fit based on evidence provided in the sponsor documentation (e.g. length of employment , number of dependants etc among several other). If you note the I-134 sponsorship is a binding contract saying that you will ensure that the person you are sponsoring will not become a public charge for the US government...and H1 being a temporary non-immigrant visa...you cannot really fulfill that requirement...since temporary visas are for temporary stay and can also be revoked if deemed necessary by US state dept.
