    My in laws are visiting me from India and they entered USA (Port of entry: Chicago) on June 19th. When they applied for their Tourist Visa, the consulate in Kolkata granted them a 5-year multiple entry visa but verbally told them they can't stay more than 3 months at a time and if they overstay the 3 month period, the visa will be cancelled. However, at the Chicago airport, the I-94 card was stamped to be valid till Dec 18, 2005 (that is for 6 months).

    My in laws have their confirmed return ticket on September 15. However, we want them to stay an exta month and depart October 15 (airline ticket valid for four months sice issue). So we are worried if this could cause them any problem for future visits. Particularly because they were advised about the maximum 3-month stay in Kolkata. Does this information get stored anywhere on their system about any such verbal advice?

    Kindly advice as to what is the right step for an extension of 1 month for them?

    PS: The I-94 valididty date (Dec 18, 2005) has been written by the Chicago immigration officials by HAND. The handwriting is not particularly good and we are a little confused as to whether it is Sep 18 or Dec 18. If they depart September 15, then this is not an issue but if they want to extend, is there a way the I-94 validity date could be confirmed? (We are 99% sure that it says Dec 18 but we just want to make sure).

    The date on I-94 matters only and if it is Dec 18 , it should not be a problem. To be doubly sure, please double check if there is any annotation
    on their visas.

    In case of any doubt about the dates on the card, you can call/visit the port of entry office at the airport/near your area and confirm. Do not call
    Immigration because Customs and border patrol issues I-94s at entry and not
    Immigration.
