  • Holding B1/B2 buying property

    I'm holding B1/B2. I bought a townhouse in LA for my daughter to study in public school. I'm planning to stay with her until each landing visa expires. Let's say every 6 months goes back to my home country for a month and then comes back into the States. I know there will be a violation of B1/B2 that may lead to the problem of entry.
    Is this the valid reason to get into the states and stay longer by saying that I need to take care of my property!

    Nope, it won't fly. "Property maintenance" is not something you can offer as a basis for entry to the U.S. as a visitor. It makes more sense for your daughter to get U.S. citizenship, and then petition you for an "Immediate Priority" visa (IR-5).

    Even if you don't try to persuade an immigration officer at the Port of Entry that your reason for frequent visits is to "maintain your property," your lengthy stays are likely to be perceived as misuse of the visitor visa privileges.

          My sister has already filed petition for me since 2004/4. I still have to wait for about 3-4 years more I guess. I'm planning to wait in the States by changing status from B2 to F1. So that I can keep myself stay in the States legally and at the same time to take care of my daughter.

            yes, that is a better option than trying to use your B1/B2 as you wanted. That would have resulted in problems.
            another piece of advice; status change to F1 can be unpredictable, so go through a very good attorney.

              RayB, like my case? Can my daughter apply IR5 for me now? She's only 14 even she's a US citizen.

                Peace999, the only problem is that I cannot leave the States until I get my GC. It may take several years.

                  IR-5 cannot happen till your child is 21.

                  If you are very rich, you can opt for an EB-5 investor visa ( invest min. half a million)

                  there can be other options depending on your background. Please post;
                  1what is your birth country?
                  2.what about your spouse and what is her birth country?
                  3.what is your education ? what field?

                    No, a petitioner must be at least 21 years old.

                    Also, as Peace posted, an F1 status may have a downside if you cannot maintain its requirements (though it might provide you more security than an expired B2 status).

                      I used half million to buy a townhouse, I do not have another half million to do investment. My home country is Hong Kong.

                        options;
                        1.apply for the 2016 green card lottery of US govt. Hong Kong borns are eligible. if you win it, GC will come much sooner than your sister sponsored GC.
                        2. Employment based category 2 is current for a lot of countries including hong kong. If you have an advanced degree like masters or a bachelors + 5 years experience
                        look for an employer who will express file your green card under EB-2. you will get it in under a year.
