  • Visitor Visa extension question ?

    MY mom has 10 years multi-entry visitor visa (B2-Visa). She is here since July-2005. This is her first visit & expires on Jan-3rd.

    We plan to extend her stay for 3-months. Is it recommended to apply for extended stay ? As I read in forum if extension gets rejected, "even the 10-year visa gets void/cancelled..." is this true ? If so, why would extension voids/cancels the approved multiple entry visa ?

    She has appox 40-42 days left on the current I-94, with all the holidays coming, is it ok to apply for extension (meaning do we have suffient time for INS to respond) ?

    please let me know. Appreciate the clarification.

    I am a little confused.....I think I answered your other query. Do you want to postpone your mom's trip by 3 months or concerned abt her 1 day late departure from here????

    I would at anytime not suggest an extension unless emergency and/or must.

      Ideally, If there are no complications I would like to apply for an extension for 3-months. If not then want to be sure that by travelling on Jan-4th won't to voilating the law of over staying (with I-94 valid till Jan-3rd).

        Responses to extensions applications usually take a long time.
        A lot of times they come after the expiry date on the original I-94.
        If the response is a denial, you must leave immediately. This will not
        cancel your existing visa but depositing your old I-94 at the departure airport
        will record an overstay , so you must carry all evidence of extension application and the denial letter to convince the entry inspector on your next visit to the US.

        Moreover, extensions are not granted for casual reasons.
        6 months is considered to be long enough a stay for a visit.

        For the above reasons, I advise you avoid the extension process
        unless it is really required. And do not make the mistake of planning their
        departure on the last day. If there is an unforeseen delay even by one day(weather, other
        reasons), your parents will be considered to have overstayed and
        their visa will become void.
