  • B2 extension and 10 year visa renewal

    My parents's 10 year b2 visa stamp is expiring in december 2016 and their current i94 is valid till november 2016.
    We are planning to file for extension next week for additional 4 months.
    1. is their stay after december 2016 is valid though the stamp in passport expired but with pending extension application.
    2. once they go back to india planning on renewing the 10 year visa, will that renewal have any problems due to the fact that extension application was filed. we know that if extension application denied we need to leave country immediately.

    Personal experience: We applied for extension of stay for my parents (B2) in 2009. It was denied making them out of status as they were past I-94 date. They were asked to leave within 30 days which they did. I emailed us consulate and asked about their visa validity before their visit in 2010 as I read in several forums that their visa is cancelled because of their extension denial in 2009 making them out of status. I got reply back that their visa's were still valid. After the denial they visited US 3 times without any issue.

    While renewing their B2 visa, there is a point in DS-160 where they ask if you were out of status at any time. I honestly wrote the details. They fell in category where they had to go get fingerprinted and not interviewed. They got their 10 year extension without any problems without the interview. All they had to do was go submit their fingerprints and get picture taken. 15 minute tops.

    Just to be safe, if you can avoid this by not submitting the extension, it will be great because apparently you are planning on applying for extension right away.
