  • Visa extension

    To whom it may concern:

My daughter having a British Passport entered Us on waiver visa, On 23rd June 2007. I need to extend her visa which is expiring on, 21st September. 2007. I need all the required information for her visa extension. Also i would like to know, what is the latest time we can apply for her visa extension before her expiry date.

Persons entering US on visa waiver program can NOT extend their stay in US. They need to return back and come back.

Or they can enter on regular visitor visa and then apply for extension next time.

I believe most interviews take place in oct, nov, dec and jan.

You can leave after the cs test and reenter again in nov armed with interview letters ; you can request the officer at least 3 months.

YOu could also take the extension route. Apply in late sept. They take many months to respond and you will be legal till you got a response even if you stayed beyond nov 4. Sometimes they respond early too and if it is a denial and you are past nov 4, you will have to leave asap.

So weigh out both the routes and choose.

Remember , if you apply for an extension , keep a copy of your I94,
the denial/approval letter and your boarding pass when you leave US ; you may require them at next entry to US.

ususally the ext process takes many 2,3 months but i have read rare reports about quick one month responses.

I guess do not need to submit the statements you submitted in India.
Just provide a cover letter with the reason for extension. Read I-539 form
for full details and required accompanying docs. You may also take the help of a good attorney but it will cost.

                Remember this if you go the extension route;
If you get a denial and you are leaving after nov 4, you will be depositing
the I94 with nov4 date at departure and the system will record an overstay.
When you visit next, this will pop up on the computer screen of the inspector and you may have to show him that you applied for an extension and that you were denied, show denial letter or he can apply sec 222g
(visa void due to overstay and send you back.

There is no inspection at US departure so there is no problem leaving ,for anyone overstaying. All you have to do is give your I94 to the airline crew while boarding. KEEP A COPY of your I94 for your record. About re- entering, ,mostly, they let you in if you show them the denial letter and the day you left (boarding pass), but this has slight potential for problems, let us say you lost the denial letter or forgot it in India, the officer could cancel your visa applying 222g ( visa void due to overstay) and send you back.

I suggest you leave after step 2 cs ,this is a safe thing to do. Extension is little complicated. You won't have any problems reentering in Nov. since you only stayed a few weeks on your first visit. Just show them the interview letters as the purpose of visit.
