    Hello all,
    My mother visited USA 2 times on 10 yrs multiple visitor visa and after 6 motnhs stay applied for an extension each time and got approved and stayed for 3 more months each time:
    first time: from sep 2004 to June 2005 ( first extension : total stay 9 months)
    second: from dec 2005 to Sep 2006 (2nd ext : total stay 9 moynhs)

    And just in the last week she came to US(me) again for the third visit and at POE the officer called my husband and asked the reason for her stay of 18 motnhs in US in the past 3 yrs and after some reasons the officer said that they r giving her only 2 months stay. ie from Aug11 to Oct 11 2007.

    Please answer these:
    I want to apply for her ext now so that she can stay for somemore time ..
    Will there be any risk in applying?
    By what date shuld I apply for extension?
    How long will it take for the result of ext come back after applying?
    Is there any chance that she gets atleast 3 motnsh of ext?

    Any other info regarding this matter is appreciated.

    No offence, she was lucky to get 2 months. A more strict officer would have sent her back. There have been reports of parents misusing the visitor visa being sent back. This time an extension approval is very unlikely.

    A visitor visa is for visits and not for staying 9 months out of 12.
    If you want her to stay in US permanently, you should consider other visa options for her --H-1, green card.
    If she continues like this , she is likely to be sent back from the airport the next time.

      You are kidding us right? You cannot seriously be asking questions like the ones you asked and be seriously considering yet another extension after such a clear warning from the Immigration Officer?

      Get this straight, your mother is going to have her 10 year multiple entry visa be declared void by US Immigration very soon, if she applies for another extension.

      What I would really like to know is what reasons your husband gave to the Immigration Officer over the phone to explain why your mother's stayed in the US for 18 months in the last 36 months on a tourist visa.

      My only advice to you is to make the most of your mother's two month stay. And if you don't want her to have her visa be declared void, do not have her over for the next 3-5 years.

        The previous 2 extensions were applied by my elder sister when she had 2 deliveries(babys) for her and extended my moms stay .Now Iam expecting a baby in sep last week and Iam the one who is affected by those previous extensions which were done by my sister . Iam having a baby in sep last week and mom can stay only till oct 11 ...I need her at this point....that is why Iam planning to extend again .I asked for any suggestion as to how to procced with her extension so that theres no risk of denial of extension or cancel of her 10 yrs visa.. Plss give ur best advices which I need from u knowledgeable ppl now but not ur frustration .

          Just so that it's clear ....

          Just to make it clear, U.S. authorities do not consider that the girl's mother needs to be with her during/after the delivery of a baby.

          This custom is purely Indian.

          A lot of visa applications have been rejected when the reason for travel was mentioned for delivery.

          However, if there's a major medical surgery then they're more than willing to grant the visa and extension as required. In such cases this can be expedited too and also the local senator's office helps out.

            1. extension is allowed based on case by case and also the person looking into it has a say on it.
            2. if they see that the extensions are frequent or being habitual, it may not be advisable as once they are denied, i think the visa is invalid (not % sure, but ive heard)
            3. if there is a gap between the last two instances and now, you have a better chance as they dont really make a big fuss out it as long as they know they have ties back at home (which their original application may prove).
            4. never say you want a baby sitter, which is practically a job description in US and not considered a family orientation or cultural thing

            all the best, and dont blame your other family (like sister or brother) for bringing in your parents when they were in need, as it may pose you as really in need of a baby sitter than having your parents advice/support during the time you need them.

            if there is no medical condition that you can specify, use more generic terminology saying they missed to visit some places last time and would love to visit north for fall (i dont know where you are!! ).. if possible get some confirmed tickets and provide the details if they have enough room on the form

              Your mother was here for 18 months out of 24 months from september 2004 to september 2006.

              Now you are saying your sister had 2 deliveries in those 18-24 months.

              Wow! Her husband and she were careless about more than just the visa extensions then.

              Well anyway, how about having your m-i-l or even your sister over to help you with the post-birth care? That way your mother does not have to risk losing her visa.
