  • If visa extn denies?

    Folks,

    If the I-94 extension is denied, will the 10 years multiple entry visa gets cancelled? one of my friend said now a days Immigration is cancelling the Multiple entry visas for the I-94 denial?

    Can some one clarify this..

    Yes, if you stay beyond date on I-94.

      Thanks Orion for the quick resp..but lets say I applied extn and I got the reponse after the past data of I-94 then, how do I need to handle the situation?

        As per rule 222(g), if you receive the extension decision as denied, past the i-94 date. Your visa MAY become void.

        It is up to the officer at the Port of Entry and how he enforces that rule, whether your visa will be cancelled and you will be sent back or you will be allowed in.

        That is why it is a big risk to file for an extension so close to the i-94 expiration date.

          My mother in law's I-94 is expiring in 1st week of April, I will be sending the extension docs in a week or so? is this ample time to get the response?

            probably not. Usually it takes at least 3-4 months...

            Unless there is an emergency and/or the reason for the extension is "Water-tight" and you are sure it will be granted. Then I would rather not risk losing a 10 year visa.
