  • Visa Extension

My parent's Visa is expiring on 15 May and they want to travel US on 23th April 08. They are coming here first time on this VISA.They want to stay here for 2-3 months.
Do I let them come here in US and then apply for extension ? Also Can I apply for extension when they are here siince it will be only 20 days left for their VISA expiry after they arrive here? Can you please guide?

The visa allows them to apply for entry at the border. The I-94 they receive determines the length of the authorized stay. The date by which they must leave on the I-94 is not limited to the date on the visa which is the latest date that they may apply for entry.

You cannot apply for an extension of the visa; they would need to apply for a new visa. Applying for an extension of the stay if there is not a very good reason is not recommended.

An extension of stay is unlikely to be needed because many visitors receive an I-94 authorizing the maximum allowable time of 6 months and you say they want to stay for 2-3 months. Post for additional help in the event that their I-94 does not allow them to stay for the desired length of their planned visit.

As long as they leave before the I-94 date, they are in a good position to obtain another visa.

    Have a great visit!

This is correct. No need to get a new visa. They will be allowed to enter the USA for as long as they visa is valid on the date they enter and they will be allowed for 1-6 months, regardless of how long the visa is valid for.
