Per my understanding, if an extension is filed before the I-94 expires, the person is still in status. In other words, when the application is pending, the person is in status.
My two questions are:
1) What happens to a person who filed for an extension, the extension is denied, but that person has already left the country before the decision was made?
2) When an extension is denied, if the person is still in US, is he/she considered out of status the date the decision is made (if still in US), or since the I-94 expired?
Any insight is greatly appreciated.
