I-130 and the CSPA
My wife is a LPR, and submitted the I-130 for her biological daughter (F2A). The I-130 was approved on January 22, 2016, and her daughters priority date is September 9, 2015. Her daughter will turn 21 years old on February 26, 2017. Current visa bulletin (November 2016) shows visa available for priority dates before January 22, 2015. Her daughter will most likely turn 21 years old before a visa is available based on her priority date of 9/9/2015. Wondering if her daughter is eligible for any protection in the CSPA? Will she be able to deduct the time the visa petition was in processing?
