  • Conditional Green Card

    Hey everyone!
    Quick question: In order to receive the 10 year Green Card right away, and not the conditional 2 year Card, does it depend on the Duration of the Marriage (minimum 2 years) at the date of application or at the approval date?

    Our interview is scheduled for the end of January and our 2nd anniversary is coming up early March. I'd be almost bummed if we're missing that 10 year mark by only a couple of days.

    Does anyone have experience on how long after a successful interview the Green Card usually gets approved?

    Our anniversary was Jan 6, had interview on the 13th of November. Approved the same day and had card in a week. Missed by a month and a half..... was hoping interview was in January but no deal. Unless you postpone interview you will be in same boat. Unless you do horrible in interview and it takes awhile to approve. they know when your 2 year mark is … I think they time it like that LOL

    11-13-18 Interview
    11-13-18 New card being produced
    11-15-18 I130 and I485 Approved
    11-20-18 Card Mailed

      On the date you become a permanent resident, which for Adjustment of Status, is the date the AOS is approved.

        Oh yeah this does seem to be very similar to your case. They do probably time it so that it's most frustrating to everyone involved. For us it'll also be about 1 month of missing the mark.

          Hey! Just to close this thread out: I had my interview on January 23rd. They did not approve on the spot, but my case got updated to "New Card Is Being Produced" on the 25th of January.

            My EAD Card was mailed to me 01/24/2020
            My I-485 Interview was scheduled 01/23/2020

            I have been married for almost 3 years coming up in April, Will I be getting 10 years green card right away if I get approved?
            10/02/19 AOS Package received.
            11/01/19 Biometrics completed.
            01/22/20 I-765 "Case was approved"
            01/23/20 Form I-485 "Interview was scheduled"
            01/27/20 Interview letter notice.
            01/29/20 EAD Card in hand.
            03/04/20 "Interview completed but my case must be reviewed"
            03/05/20 "New Card is being Produced"

              After 2 years everyone get 10 years Green Card.

                Yes you should or might get the green card, however, it is MAINLY BASED on how you strongly support your bonafide union with substantial (more than a few) evidence. In other words though they should technically issue to you a 10 yr green card because you are married for 3 years before the application/interview date, you can still be given a 2 year conditional green card if your supplied evidence lacks sufficient and solid proof of your union.                   No, I don't think this is possible. If you are married for 2 years as of the date you become a permanent resident, you become a non-conditional permanent resident. If you get a card in a conditional category, that is an error.

                    Not an error. This is the experience of someone I know. The IO was not satisfied with the proof of documents and the individual received a 2 year conditional.

                        Who is a conditional permanent resident is specified in law. It is not up to the IO.

                          USCIS can give 2 years conditional green card even after 2 years of married if a couple do not provide enough evidences and uscis feels it’s a scam! But it’s not very common situation.

                            If that happens, the person can file I-90 to replace it with a 10-year green card for free, due to it being a USCIS error.
