    Sharing an update on our case related to EB2 to EB3 downgrade filed on Oct 30, 2020. I765 / I131 approved on Dec 10, 2021. GC EAD card received for self and spouse on Dec 16, 2021 from Nebraska Processing Center with a validity of 2 years. Waiting for an update on EB3 I140 downgrade

      Out attorney does a horrible job in assisting us to prepare for the interview. They refused to give any instruction before we have the interview notice in hand. That could that how long who knows, USCIS set the letter out 12/1/21.
      Only 2 things I can say about preparation - 1. Have copies of your documents 2. Check answers on your I-485. Do not panic and not overthink.
      The interview happened on the 13th, I was asked about the following documents: passports (old/new), IDs, employment letter, 485J, paystubs (I had them for the last 1.5 months), my W2 for the last 3 years, and my current H1 (+ copies of that).
      Questions: your full name, position you working at, company you're working at, where you were born and when, DOB, my dad's and mom's names, how long you're working for that company, SSN and phone number, and then YES/NO questions from I485 - that's it

      In my opinion, if you have been called for employment based then there might be some mismatch In your documents. In my case, there was one YES/NO question about the military which I answered differently about 5 years ago when I filed my documents for an H1 visa. REMEMBER - they have records of all your answers given by you at any time you filed any visa-related document, I would say it again - all your previous answers in documents recorded in the system - no joke.

      Again, in my case, the officer told me after everything, that the only reason I was called for the interview, is that military service question which was not cleared for them. After that officer said that she would approve my case. The status of my case changed the same day in about 4 hours. Total interview time was about 35-40 minutes, relaxed. At this time now my card is produced and I'm expected to get it on 20th of December.

        Filed on Oct 30, 2020.(PD EB3 2010)
        I got my GC EAD Combo on 6/24/2021. till then no update at all. Waiting for RFE for medicals. My Attorney is not willing to send medicals without a RFE. I know now USCIS itself is asking to send medicals along with I485 filing. In October this is not the case, Don't know how long is the wait for RFE. Any insights ?

          Unfortunately there is not common pattern on the wait time for RFE's. You can reach out to Emma and find out if your case is moved to local FO. Usually the Medical RFE's are sent once the case is transferred to your local FO.

          • Original priority date from 2014 June for EB2 category.
            Downgrade, Advance Parole and EAD filed in OCT 2020.
            Filed for processing with Nebraska service center.
            Received my EAD/travel card and I140 downgrade approval all together in end of October, 2021.
            I-485- Fingerprints were taken in Mar 2021.
            No other update. When is the medical RFE typically issued?
            Would I need to wait for dates get back current again in order to receive my GC?
            I see that EB2 dates are again moving ahead of EB3. Does that mean people again file for I140 upgrade and then Wait for I 485 approval?

                - Again no common pattern. Quite a few folks have got their GC's between 2-4 weeks of USCIS receiving the medical forms. A couple of folks that I knew had to wait for around 2-3 months. Usually this is based on your local FO and how fast they have processed the cases in the past. If you have to send medicals back to either NBC or Texas service center's it might take longer than few weeks. FO's process them quicker. (All these are based on past experiences around Aug / Sep / Oct of this year).

                  I agree with mcaeb1guy, a few weeks if local FO. In our case, we had to send it to Texas Service Center and wait for a little over 5 months.
                  Nov 2018 - Package sent - EB - Texas Service Center
                  Day 1 - Package received at the lockbox
                  Day 999 - Card delivered to me - Aug 2021

                      Got RFE's for only 3 members in family. myself dint get the RFE yet. Called EMMA. it says not yet sent for my case. we have medical appointments in two days. Can we send completed medicals for all four us? Any suggestions folks?

                        I'd say wait until you get your RFE before sending the medicals. Send it for the others.

                          1 - Ideally you can wait till you get your RFE to send in the medicals and just send your families forms.

                          2 - Are you the primary applicant and you are yet to get the RFE and only the derivative application got them? Also did the RFE come from Local FO? - Another option is.. You can send in your medical as well with a cover letter with your Receipt # on top along with your families forms. Check with your local USCIS Physician if they can give another copy of your medicals for a small fees.. (Usually doctors take average of $300 to fill in the I693 forms and to perform tests. You can check if your doctor can give a copy of the same I693 for you at a later date for a lesser fees say some $50 or $100) then you can take a chance and send yours as well now. In case USCIS sends another RFE for you... then you can get one more I693 form from your doctor and send.. I believe these are some of the things that people have done in the past. Not sure if the same will work this time.

                          Again it depends on what you want to do and what your immigration lawyers are advising you to do.

                          • PD: 03/04/21, FD: 10/15/2020. Initially filed 485 under EB2 at NBC. Case transferred to TX in April 2021. No update since then. Any one in a similar situation?

                              I am not the primary applicant. I am a derivative applicant. RFE come from local FO. I am weighing all the options. Thank you though.
