Hi folks - I'm new here.

India PD July 2011. Downgrade filed EB3 in October 2020 in the big rush. Nebraska Service Center. Did not include medical.
Filed i485 as well as EAD/AP, the latter separately a few weeks later i485. Got receipt notices for all.

Did biometrics in April 2021. in August, I got a notice saying my I485 application was transferred to NBC in MO. Thereafter, no news so far. PD has been current for a while.

Have not received EAD or AP. AP Application status says "we received your application and sent receipt notice" from Dec 2020 still.
EAD Application status says "Fingerprints applied" from April 2021. I485 shows fingerprints applied, and subsequently the transfer to NBC in August 2021.

Anyone else in my boat, still waiting with no news, no EAD/AP, and no RFE for medical?
Feeling really stressed out and anxious about the whole process..

I have filed i-140,i765,i-131,i485 in OCT 2020 for downgrade from EB2 to EB3. I got my EAD approved with combo card. My i140 and i485 is still pending. My PD is May 2014. My pd is not current yet for EB3 and EB2 now it was on OCT 2020. Is that mean I will not get i485 until my PD will be current. My PD will be current in APR2022. Should I file interfile? Any advise would be appreciated.

    Congratulations...!

Recently I saw this post from USCIS.

Does this mean if I upgrade to EB2, I'll have a better chance of getting my I-485 approved sooner?

My attorney is saying that there is no need to upgrade since you are current in both EB2 and EB3. Reading the USCIS advice, I'm not so sure.

    Thanks!
I second the opinion of your attorney. Just wait...

Oh Thank you. I submitted after receiving the RFE only. Let's wait then.

[QUOTE=brownparda;n777630]All, based on the recent alert / advice from USCIS, are we (downgraded EB2 to EB3 folks in Oct 2020) eligible to transfer back to EB2 since there might be a better chance of a faster approval? Sent a note to my attorney. Thought I'll aske here as well and spread the word.

My opinion would be don't interfile to EB2 unless your EB2 priority date is current. If it is, then by all means go ahead but know that when you interfile, you have no way of confirming that your request to move to EB2 was accepted nor be able to track the status further. The upside is that you will not have to shell out money to do fresh 485s again. Again, go with your attorney's advice and make sure you choose the right and capable attorney.

My thoughts...please check with your immigration lawyer for advice...

No other update. When is the medical RFE typically issued? - Depends on the Local FO / Processing center.
Would I need to wait for dates get back current again in order to receive my GC? - Yes, you need to wait for the dates to be current again for USCIS to allocate a visa number and process your GC.

I see that EB2 dates are again moving ahead of EB3. Does that mean people again file for I140 upgrade and then Wait for I 485 approval?
Anyone with any input for me?

    @hr2021
1 - Ideally you can wait till you get your RFE to send in the medicals and just send your families forms.

2 - Are you the primary applicant and you are yet to get the RFE and only the derivative application got them? Also did the RFE come from Local FO? - Another option is.. You can send in your medical as well with a cover letter with your Receipt # on top along with your families forms. Check with your local USCIS Physician if they can give another copy of your medicals for a small fees.. (Usually doctors take average of $300 to fill in the I693 forms and to perform tests. You can check if your doctor can give a copy of the same I693 for you at a later date for a lesser fees say some $50 or $100) then you can take a chance and send yours as well now. In case USCIS sends another RFE for you... then you can get one more I693 form from your doctor and send.. I believe these are some of the things that people have done in the past. Not sure if the same will work this time.

Again it depends on what you want to do and what your immigration lawyers are advising you to do.
I am not the primary applicant. I am a derivative applicant. RFE come from local FO. I am weighing all the options. Thank you though.
