I believe what @vsamsr10's doctor says is purely from a medical perspective while what you are saying is from USCIS perspective. I believe the doctor wants to redo checks as he believes things might have changed with your body in that period| This is my personal opinion and is not to be construed as legal advice |

Unfortunately no. My attorney says let's wait for 4 months after RFE response submission before considering to bump it up to premium. It's really frustrating but I don't want any risk to my 140 approval so just waiting.Originally posted by rmath View Post

That's what I thought. It is just the recommendation from my attorney to wait. He says though that my case is strong. I myself don't see any issues or risks in my case because I'm at a director level for a major international firm and I meet all the requirements for a L1A but I decided to go with attorneys advise. It's too bad that I'm going to miss the opportunity to get a GC in this year. In keeping my fingers crossed that the dates don't retrogress for EB13. Let's see. Fingers crossed. Even if USCIS says that the medical form is valid for 2 years, they can (and do) ask sometimes for new medical even if the previous medical is less than 2 years. It happened to us and I have seen a couple of people reporting that. They just said that the previous medical already expired.Originally posted by twisted-pixel View Post

This 2 years was temporarily extended to 4 years due to covid processing delays but I'm not sure if the temporary extension is still in place.Nov 2018 - Package sent - EB - Texas Service Center

shiva_82 , Don't worry I have been observing patterns of 140 RFE and the response from USCIS after 3 months with a straight approval of 140. Just hold on its just matter of time for you in next few weeks. Am confident given your profile its pretty straight case.
I have my 140 pending state still since 27th July'21 with Nebraska. State has not changed from "case is received". Been close to 13 months but holding on to it. Many of my coworkers who applied in April and May of 2022 got their 140 approved in less than 3 months. It certainly brings in anxiety but am sure the application must get us the result anyhow.
I think USCIS is having some strategy in the recent few weeks to get GC EAD and AP approved for some cases in 2021 and 485 for applications from 2021 since its closer to Spe'21 and they have to use the visa. Am sure the next batch of processing will be focussed on 140. Once after 140 it might just be few weeks to months away to get GC.

Priyapandian Thanks for the note. It helps ease some anxiety. I just hope that they look at pending 140s for all cases where there is a visa number readily available. I've seen in one of the USCIS links state that they can also approve both the 140 and 485 together, if a visa number is readily available and the 485 is documentarily complete. Actually, I did not. It was based on my lawyer's recommendation. Today will be 1 year since my file was transferred from NBC to Nebraska and 15 months since it was applied
No information whatsoever!
Based on the timelines of my Field office, it is 16 months and Nebraska is 18 months. I m not sure if i will have to wait until 18 months.
