Marrying a US Citize while traveling on a B1 Visa

    RFE is for BC

    Received the RFE today, It is for Birth Certificate as i was expecting coz i had sent my SSC Marks Memo as a Secondary Evidence which they didnt accept because ( and i only came to know this today ) it doesn't have my Mother's name and birth place. It sucks that they don't have it specifically mentioned anywhere that the secondary evidence requires all these four for sure and also that it needs to be old and not something recent. anyways so i called home cause luckily when I was telling my mom yesterday over the phon about all this, she mentioned seeing my BC somewhere in the closet at home. So I called home today and luckily by Allah's grace they were able to find it. Having them scan and send it to my email so that I can print it out. I would be sending only the copy of the original BC, to USCIS since they requested for a copy. Will they ask for the original too in any case? And would it be safer to also have them mail ( not email) me the BC through Speed post or something?

    Could somebody enlighten me with some links to postl services, well actually cheaper postal services.

      Good to know that you got simple RFE, thanks to Allah they didn't ask any otherthing about marriage.
      yes, you should send by mail, while sending you have to put the RFE number on envelope. I think they send you a letter with file No etc to include in your RFE response package.

      The address may be on the letter where to send, if they have any fedex/UPS address mentioned you can send with them. Keep all receipts whether you mail by postal or fedex etc.

      Make sure your birth certificate have both of your parents name include plus place of birth, and date of birth.
      They mentioned in there website that if you don't have birth certificate what are the acceptable documents.
      I don't have a birthcertificate, I submitted notarized document from my Mom and Non availibility certificate from Municipality and secondry evidence as my SSC certificate +Passport copy.

      If you have any questions let us know.

      One more thing at the time of interview the IO will check your birth certificate, and also all your previous and current passports.

        Response to RFE Mailed Today

        Thank you Zoom. Alhamdhulillah I mailed the response to RFE with a copy of my BC. FYI, this BC is original and was made when I was born and not recently so Alhamdhulillah it should be fine. Yes it has all 3 names and DOB and POB and also registration number and stuff.

        They did not mail any envelope and the RFE they mailed had two piece of papers. Page 1 of 2 had the address and my application alien number and stuff. It stated the same stuff like According to code of Fereal regulations and 103.2b crap bla bla bla bla...
        Well I mailed it to U.S. Department of Homeland Security, PO Box 648004, Lee's Summit, MO 64002 as they mentioned in the RFE notice.
        Should reach them by Thursday.

        BTW Thank you Zoom. And one more question, What all should i be taking to my Biometrics Appointment?

        And also can I travel within the United States based on my I 797 cause my I-94 expired in January. I called USCIS and they said that I'm legal to travel within the states with my I-797 and that it shouldn't be any problem. Please advice... thanks a lot....

          That's good your BC have all the names with registration no. Once they received and reviewed you will get the interview notice. Usually within 3 to 4 months you will get the interview notice.
          You did a good Job, I think you included a copy of RFE in the mail which the A number.

          Yes, you can travell any where in the US. Once you get your EAD (Which will be minimum 3 months after the application) you can go and get your Social Security No, after that go and make driving licence. ( one point: At the interview some time the IO checks the driving licence address make sure you and your spouse is same on both of ID's. if you unable to get driving licence/ID card as you got delayed EAD or SSN before interview if the IO asks then you can tell them)

          For Biometric appointment you have to carry your passport ( I think you dosn't have a state issue id/driver licence).

          Now onwards you have to plan for the interview. Make all documents ready, wedding albums, regular pics, Honeymoon pics, vacation pics, reception pics, receipts etc.
          Make sure where you live the lease should be on both of your name ( if not go to your land lord and add your name) Some IO's are so picky on lease documents. Any bills (Cable bills, phone bills, cell phone family plan, both of your names should be there. If atleast 3 months bills.

          You can request to add your name in the bill, and they will add it.

            Well, we already have the Lease document as we had to send a copy of it with the application to prove joint tenancy and also our address.

            I'm happy but little upset that it has been a month already but the USCIS cycle will start again and count 90 days from the date of receipt of RFE because of missing initial evidence. Anyways i will get over with it.

            And No i don't have any state ID card for now. All I have is my passport.

            But I shalll get on it once I get my EAD ( hopefully Insha Allah in atleast 60 days).

            As far as the joint bank Account is concerned, I think I can get my name added on to it but I wonder if the bank will deny because of Expired I 94. Anyways I will check with them and update later.

            • All documentation establishing your eligibility for Lawful Permanent Resident status.

            • All travel documents used to enter the United States, including Passports, Advance Parole documents (I-512) and I-94s (Arrival/Departure document).
            • Your Birth Certificate
            • Your petitioner's Birth Certificate and your petitioner's evidence of United States Citizenship or Lawful Permanent Resident Status.
            • If you have children, bring a Birth Certificate for each of your children.
            • If your eligibility is based on your marriage, in addition to your spouse coming to the interview with you, bring:
            • A certified copy of your Marriage Document issued by the appropriate civil authority;
            • Your spouse's Birth Certificate and your spouse's evidence of United States Citizenship or Lawful Permanent Resident status;
            • If either you or your spouse were ever married before, all divorce decrees/death certificates for each prior marriage/former spouse;
            • Birth Certificates for all children of this marriage, and custody papers for your children and for your spouse's children not living with you;
            • Supporting evidence of your relationship, such as copies of any documentation regarding joint assets or liabilities you and your spouse may have together. This may include: tax returns, bank statements, insurance documents (car, life, health), property documents (car, house, etc.), rental agreements, utility bills, credit cards, contracts, leases, photos, correspondence and/or any other documents you feel may substantiate your relationship.
            • Original and copy of each supporting document that you submitted with your application. Otherwise, we may keep your original for our records.
            • If you have ever been arrested, bring the related Police Report and the original or certified Final Court Disposition for each arrest, even if the charges have been dismissed or expunged. If no court record is avaliable, brina a letter from the court with jurisdiction indicating this.
            • A certified English translation for each foreign language document. The translator must certify that s/he is fluent in both languages, and that the translation in its entirety is complete and accurate.

              The interview letter is common to all marriage AOS. In your cas you must prove it is a bonafide marriage.
              - In Citi Bank they can add your name to the account or you can open a new joint account.
              - Try to pay the house rent and any other bill through this account and keep all the statements incuding copies of the cashed checks.
              - For Bio metric appointment passport is enough.
              -As you came on different visa otherthan K1 etc you should prove its not a sham marriage.
              - All the documents mentioned you can take with you but some time they seperate the spouse and take the interview. In that case you answers and your spouse answers must match.
              - you guys should know each other family members, favourite color, food. Did your parents accepts this marriage. Where you met, how you met, did you know before coming to US you gonna marry him. Do you have any dating, love letters, emails, ******** messages etc.
              - Don't worry i am mentioning if in worst case scenario. so you must prepare.

              Which side of the Bed you sleep, if you are a female then did your parent accept this marriage etc.
              Whats your parents reaction.

                Biometrics Time

                How long does it take at the USCIS office for the BIOMETRICS to be done?

                Like my appointment is at 11 AM. I know that I would have to fill out a form inside and also that my FP and Photo will be taken. But I wanna know if it would be as per the schedule at 11 AM or would i have to wait in a line or something? I really wanna know so that my partner can take off or just drop me there. Because as far as i know they won't allow him to accompany me inside, right? So we don't want him to wait outside and waste his time for hours. Thank you

                  How long it will take it will depend on the crowd/people before you.
                  You can accompany with your spouse. You can go a hour before your appointment ( There is no such that you have to enter on given time). They just check your notice and let you in, and give you a form to fill.

                  In NY we entered an hour earlier and they let us in and we did our biometric before time.

                              Birth Certificate

                              Make sure you go through proper instructions for I 485 and submit relevant documents if you don't have a Birth certificate. Otherwise it will be a lot of unnecessary panga and time waste with USCIS and DHS. Lemme know if i can be of any help. Good luck.
