  • Lost replacement green card and now reentry permit valid for only 1month

    Dear friends,

I have valid Reentry permit but my replacement green card is lost in the mail.

    Details about my case
    1)Original Green card = Valid from 06/04/2007 to 06/18/2017
2)I moved to India in 2012 and ever since I was on ReEntry Permit
3)I applied for the New green card ( Replacement ) in Dec 2016 with Biometric done on 02/18/2017 . Also applied for ReEntry Permit.
4)On 10/27/2017 i got message "We are producing your new card for your Form I-90, Application to Replace Permanent Resident Card"
5)I asked for Mail reference and mail reference shows delivered but so far i have not received the mail.
6)The post office said they lost the mail.
7)My current reentry permit is valid until Feb 12th, 2018
8)My wife and kids have US Citizenship and they stay with me in India.

What are my options to Save my Green Card status? Should i just surrender PR status and apply for visitors visa?

Let me know if anyone has insight into this kind of situation. Thank you in advance.

Your permanent resident status is independent of the card. As long as you haven't abandoned residence, you remain a lawful permanent resident forever even if your card has been expired or lost. I am not really sure how the expired or lost card factors into this.

How were you planning to return to the US? If you were planning on returning on your Re-entry Permit (either the current Re-entry Permit before it expires, or the new Re-entry Permit you will receive), then you can do just that; it doesn't matter that your card is missing.

If you were planning on returning on your green card because your absence was less than one year, then you can file I-131A to get a transportation letter from a US consulate to go back to the US, due to your card being lost. (Technically, airlines are allowed to board you with an expired 10-year green card without a transportation letter, but I am not sure if any airlines are willing to do this.)

This is my personal opinion and is not to be construed as legal advice.
