  • Online Form i-130 submission or mail along with Form i-485?

    I am eligible for Concurrent filing of I-130 and i-485. I am weighing 2 alternatives - pl help anyone have any experience.
    option 1: Should I submit form I-103 online and wait for a receipt notification then send my Form i-485 along with other forms and document?
    Option 2: Mail Form i-103 along with Form i-485 and other documents together in one packet.

      I filed our I-130 online on Tuesday night. We got an email receipt with the case number immediately. The next day, the form was marked as accepted and a receipt notice posted. The priority date was set to be the day we submitted it. We live in Indiana, and the I-130 was assigned to the Potomic service center.

      I liked the online form experience MUCH better than the Acrobat fill-in-the form that we're working on for the I-485. It's not perfect, but much much better. I also seemingly don't have to worry about putting our name and page number on each page... For our evidence of "bona fide marriage", we posted a PDF document. Also, we're able to post addendums directly on the website, if needed.

      But, back to your original question, I expect that filing I-130 online will make the process go faster, but I don't know how much faster.

      online I-130 (receipt dated 7 May 2020) and I-485 (filed 3 June 2020, receipt dated 26 June ). RFIE (birth-certificate) delayed petition ~20 days. I-693 Deficiency notice received (1 Aug 2020). Waiting for biometrics notice (Indianapolis).

        Thanks for the insight and experience. I haven't used the new online system but was curious as to how it operated. It's obviously faster and convenient than filling out your paperwork and mailing it in.

          But if you file I-130 online, you end up being slower in filing I-485, because I-130 and I-485 can be filed together by mail, but if you file I-130 online you will have to wait until you get the I-130 receipt to file I-485 by mail.

            hi, thank you for the feedback. So I ended up submitting my I-130 online which I too found very easy to use. I got the receipt number next day online. But I had to wait for 3 days to receive Receipt notice on USCIS letter head. Last week, my i-485 and other forms got delivered at USCIS's lockbox facility and I am now waiting for the Receipt notification! Keeping my fingers crossed

              Married to USC, preparing documents all documents.
              My question is do I have to have a health insurance while waiting for my approval or interview? My husband's request to add me to his health insurance was denied... is there an option in the health market we can get for me or can I stay without a health insirance for now. Also Im out of status. Thank you

                I am not a expert but commenting based on whatever I read while preparing my application. In I-944, they are going to assess your situation based on various parameter and one of the parameter is health. So by not having insurance will have a impact - how much I can't say.

                  I applied for adjustment of status from my B2 Visit Visa to Marriage Visa. I submitted all the documents (I131, I485, I864 and I765)

                  They sent me a letter saying I did not mail enough money to them. I used the fee calculator on the uscis and it came up to $1225. How much should I send?

                  When I use the USCIS fee calculator should I fill up on Form I131 with Permanent Resident/ Conditional Green Card instead of EAD with pending I485?

                  They also wanted me to submit for I944. Should I include that on my next submission? Is it necessary?

                  Did anyone here got a rejection letter like I did? I submitted last May 16, 2020 and I received this rejection today. They said It is not really a rejection but I can file again.

                  They took my medical uscis form signed.by my doctor though. Do you think they will ask for another medical again?

                  If I resubmit should i include all the documents that I submitted before?

                  Hope someone out there can helpme. Thank you very much guys.

                      hi I am not a expert but can give you my opinion, please validate for your situation before using it.

                      I have filed i130 online as well and rest of the document sent in mail - my payment has been processed but waiting for the mail confirmation.
                      For I-131: I don't know what is your exact situation - but based on information you mentioned here, my guess is you have to select " Temporary Foreign Travel" as option.
                      For I-944: is mandatory for whoever applies for Green card from winthin USA.
                      Action for letter": I guess, you need to read the letter properly as USCIS normally mention in brief what is the next steps. If you application is rejected and you received back your documents - you have to start from zero. USCIS clearly mentions whether your case if denied or just application returned as you have not provided initial document/payment.
                      Medical form: I have not submitted with my original document. I am going to send only when I get a letter asking for this information.

                        I am filling in the i130 form and need your help. On the section where it requests:

                        -He or she arrived (Class of admission) : Would this be the status you first arrived or your current status??
                        -Date of Arrival to US: Would this be the date of first arrival to the US or recent date?

                              Hey guys,

                              Just wanted to give my input on this as I too filed the I-130 online and mailed the I-485.
                              • I filed the I-130 on June 9
                              • On June 10 I received notice that the application was accepted and processing
                              • On June 11 I was able to download a PDF version of the I-797. Priority date is June 9
                              • On June 15 I received a mailed version of the I-797
                              • I mailed my I-485, I-944, I-131, I-765, I-864 packet on June 16 and waiting for acceptance.

                              I found the online version of the form to be very easy which is why I did it this way. Also, The online form checks for errors so there is no way that you can submit an incomplete form or a form with incorrect information which I thought was cool. Near the end of the form there is a part to upload evidence and it tells you exactly what you need to upload so there is no way you can miss something. On the following page, you have a chance to upload additional evidence like a DNA test. Lastly, you are able to pay the fee online for the I-130.

                              Overall, I am glad I submitted online because it saved having to mail an additional packet and all the evidence that goes with it. Also, I did the application around 4pm PST on June 9 and received a PDF notice of acceptance on June 11 with a priority date of June 9 so that is really fast. I then used this same notice and put it near the top of my I-485 packet.

                              NOTE: You can still file "concurrently" even if you do not file the form I-130 and I-485 together. When you mail the I-485, you simply have to put the I-797 notice near the top of the packet so that they can see that the I-130 is pending.

                              I did this against the advice of many people on these types of forums because many just tell you not to file online and file them together because the processing will be delayed yet no one can ever give you any facts to back that up. The fact of the matter is that the online filing is still fairly new and not many have attempted to file online then file the I-485 on paper. The online version of the form is the same as a paper form and the online version of the I-797 is the same as the mailed version. There is nothing on the USCIS website that says you cannot or should not file the I-130 online if you are filing an I-485 concurrently.

                              Also, my online I-130 is being processed at the Texas Service Center and I am using an app called Lawfully to track it which estimates (based on other I-130 applications at this Service Center) that the form should be processed and approved by October 2020 to February 2020. So chances are my I-130 will finish much faster than the I-485.

                              Hope this helps give some insight.
