  • Question about OCI Card...

    Hi Folks any info is much appreciated.

    I'm H1 B visa holder and i've a 3 yr old who is holding a US Passport and PIO Card. Will he be qualified for applying OCI Card or not?

    Kid being a minor is he still need to be registered at Police Station for every 6 months for I'm planning to have him stay with his mother in India. And is it advisble for me leave to India permanently as my GC is in Process with all the proceedings it will atleast take another 2 to 3 yrs before i hear anything about 485

    Again any info is much appreciated...

      He is not elligible for OCI since both parents are indian citizens. You are good with PIO and whenever you become elligible for OCI you can get OCI for your kid.

      There is no registration requirement for minors under the age of 16. So practically there is no reason to get the OCI until his PIO expires in 15 yrs.

        Who said registration is not required for a minor???

        We were stopped at the Immigration, Chennai for not registering for my son, who stayed over 180 days in India. Finally we were allowed after we gave a reason for the overstay, and we were warned not to happen again.

        Can you point to an immigration law which doesn't require registration for minors?

          Well I read it at the official indian immigration site.

            Hi Virudhun,

            We are also presently in the same situation. My daughter is in India more than 6 months. I thought we don't have to do registration for child under 16 years of age. She is coming to US in next 2 weeks.

            When did ur son traveled to US? Also, did US immigration officers will check her PIO card?

            Could you explain me what kind of reason you gave to the immigration officer for not registering your child? Our problem is my daughte ris coming to US with my parents just want to know so that my parents can be prepared for the situation.

            I would really appreciate your help.

                I recently visited India and it is also clearly mentioned in the immigration/customs form (instructions section) that registration is not required for minors holding any type of visa.

                  Get extra immigration, customs and other forms and send scanned images to IMMIHELP or to me.
