    My fiancée has a 10 year old son and we want to bring him here to the U.S. when she gets her k1 visa.They live in the Philippines. The problem is, she has not seen the boys father since before the son was born. They were never married.He went to Manila and said he would find a job and send for her. She has no idea how to contact him or even if he is alive or dead. His name is on the child's birth certificate. How can she bring her son here if she can not find the father to sign the papers? She says maybe she can get a "late birth certificate"? That sounds to me like she may get in trouble doing that. This sounds like it must be a common thing in the Philippines. Has anybody ever heard of this problem before?

      Thank you for that link. I am still a bit confused tho. Our problem is not that there is no birth certificate, its that she cannot find the father to sign a paper that is needed for the son to come to the usa. She has a birth certificate for her son and the fathers name is on it, which it has to be. What do we do if the father can not be located? Is there a way or a form to show that he is believed dead?(but no proof of that) Or that he abandond her?

        I feel only a qualified immigration attorney can advise you on what to do in this case.Doing things any other way may bring you and your fiancee alot of headaches and probably a denial.Just my opinion.

          Thank you for your advice, I was thinking the same thing.

          My fiancée seems to think that it will be easyer to petition for him after she gets here, to send for him.
          I think I still need her to talk to a lawyer 1st.

            One more question.

            Does anybody know, in the Philippines, can you get a replacement birth certificate in any major city on any island? I think its called NSO office. Or do you have to go to the island where you were born?
