H4 Visa for an H1 Visa Holder

Hi,

My spouse is having a H1B Visa which is valid till DEC/31/2014.

What is the procedure to get H4 VISA for my spouse.

Do you have a valid H1, till when, and have been maintaining valid H1 status? What about your spouse, has she been maintaining valid H1 status?

I have avalid H1 still OCT 2016 and my spouse have a valid H1 still this DEC 2014.

You didn't answer the entire question. Have you and your spouse been maintaining respective valid H1 status, that is, have up to date payroll stubs?

No my spouse is having H1B and she is in INDIA.She never visited USA with the H1B that she is having now.

So there is no SSN and Payroll stubs.

In that case as long as you are maintaining valid H1 status she can schedule an interview at local US consulate after filling DS-160 and once approved can travel with the H4 visa.

In that case as long as you are maintaining valid H1 status she can schedule an interview at local US consulate after filling DS-160 and once approved can travel with the H4 visa.
