I maxed out on my H1 6 yrs in Mar 2014. I do not have any period to recapture.
I moved to H4 based on my spouse's H1 in Mar 2014 and I am on H4, in US since then.
My employer had filed I140 in 6th year of my H1 which got approved in May 2014.
My employer is willing to hire me back now. How can I move back to H1 now, if I can?
1. Will it be H1B extension?
OR
2. Will it be new H1B subject to Cap? Not subject to Cap?
OR
3. Will it be just COS from H4 to H1?
