    H4 EAD on New H1B

    Hello Immihelp,

    I wanted to process H4 work permit for my wife, my latest H1-B renewal starts from Feb 2016.

    Can I file I-765 based on new H1B visa ?

    Visa stamp is expired for both me and my wife. Please advice.

      Hi, I do have approved I-140, but original question was, can I apply it with renewed H1B visa startgin from Feb 2016.

        Possible. Provide a copy of your existing and renewed H1B approval notices and request the H4 EAD until the extended petition's expiry date.
