H1b Amendment/Extension

Hi All,
My employer filled my H1b Amendment/Extension and I got the notice date as 9th Nov 2015 . I am planning to travel to India on 22nd Jan 2016 . I am just confuse whether I will be able to get the petition by that time. If I ask then for premium then I have to pay for that. My center is vermont .Please advice what should I need to do .

It takes about 5-6 months to get a decision on your application when filed through normal process. You are not supposed to travel when the petition for extension is pending with USCIS. If you do, then the petition can get approved for consular process. If yu have to travel, then your best option is to wait outside U.S until the petition gets approved and then travel back. If you cannot stay out until the petition gets approved, then your only option is to upgrade to premium, get the result and then travel outside U.S.
