  • H1B transfer (paystubs mandatory?)

After getting the H1B stamped I discovered that my employer is not ready to hire me and is making lame excuses.

According to this page Paystubs not required if the existing H-1B was never used and the transfer is applied from outside the U.S.

My question is, as I have NEVER started working for them (and never visited US on this visa) can I transfer the visa to another employer?

Why don't you get your new employer to file a cap exempt H1B? In that case you would not even need any paystubs, etc.

Just an opinion; Not legal advice.

If you have never worked in US on this H1, you dont need paystubs.

This is my opinion not legal advice.
