  • H1-B Transfer Issues- Kindly Help

    Hello Everyone,

    I had/have H1-B thru Employer-A with I-94 and Visa on passport till

    30 May,2008.

    This month I transfered my H1-B to Employer-B (a consulting firm) and

    I got with that transfer new H1-B and I-94 with 3 years extension. I

    have not traveled outside country yet. Meaning my passport is stamped

    till May 30 and so is I-94.


    To my horror I found out that Employer-B has no projects for me.

    My question is - can I still work for Employer-A beyond May-30,2008

    even though H1-B has been transfered in Employer-B name and my I-94

    which is stamped on passport with Employer-A expires on May 30.


    If yes, then my other related questions are:

    A) How long can I work for employer-A

    B) If later I find new opportunity, can I get my H1-B transfer again?

    Will it be from Employer -B to Employer-C OR from EmployerA to

    Employer-C?

    C) Which company pay stubs will I need then - EmployerA or EmployerB

    D) What all things I should be careful of?

    Please advise.

    Yes, you can continue to work for A as long as their H1b I797 is approved for.

    A. Till the date of your I-94 for A or the approval I797 expiry date for A whichever is earlier.
    B. Yes. Can be from A to C provided A has a valid H1b petition for you.
    C. Depending on who you are working for and maintaining your H1b status.
