  • Transferring H1B visa

    Hi all,
    I had a few questions. Would be great if someone can reply to this from their experience.

    I have made through the lottery this year(2008), and the approval has been done by USCIS.
    The only thing left now is stamping. The question I have are :-
    1) How long does the stamping process takes ? How much time before the interview dates needs to be taken ?
    2) I want to transfer my VISA from company A to company B. Company B has told me that this will be pretty easy and all I need to do is get my H1B stamped, come to US and then get the VISA transferred immediately in US. Is this process so easy ? Dont I need the pay stubs or any such documents from company A ?

      Read this for H1B transfer:
      Can I transfer my H-1B visa to another company?

      You may apply for an H1B transfer to another company. For this you need a valid employment in the U.S. Also you have to prove that you have recent pay stubs (at least 60 days old) and last year W2 forms (if applicable). If you do not have recent pay slips, then you may need to explain the reasons to USCIS. (Unpaid vacation or long sick leave approval letters from your current employer may be considered.) As per law, the petitions that were filed after the last date of employment are not eligible for change of status or change of employment because the applicant becomes out of status when the applicant loses the job. The laid off H-1B worker will be considered out of status even though he has valid H-1B visa in his passport or valid I-94 card.

        Do you mean that I cannot transfer H1b without working for the employer who filed my H1B for atleast 2 months ?

        Can I not transfer it without any pay stubs or before starting any work for him?

            But entering on a H1b with no intent to work for the employer is fraud. The transfer may or may-not be approved if applie dafter Oct 1st and without paystubs.

            OP needs to have the new employer have a H1b petition approved and travel with that petition rather than enter and file for a transfer.

            I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

              you need atleast 1pay stub for transfer.. read FAQ carefully.

                Thanks for all your replies....
                When I talked to the company B(where I am planning to transfer my visa immediately after stamping), they said that it is very much possible.

                They said that instead of going to the company A location, I should straightaway come to company B location. They would arrange for my stay and would get the VISA transfer done in 3-4 days !

                After reading your replies, I am a bit confused. If I am determined to go for a transfer, do I have to necessarily work for employer A first for initial few months ? Is it easier to go for a transfer after the stamping is done or before the stamping takes place ?

                Sorry, this is my first US visa .... So, my questions may sound a bit stupid and confusing !

                  Also, what happens in case I have the stamping done and the concerned employer does not find a suitable job for me for a long period of time or the company closes down?

                  Does my VISA stands redundant in that case ?

                      I think you are going through some agents.. hmm ?? anyway.. but if they not paid u then you are out of H1B status for that you must have to get paid.
                      or your employer not paid you make complaint to DOL , you can file form WH-4.

                        Thanks for your reply ! No, it is not thru some agent. The company is a genuine one. Only thing is that they are taking a long time to apply for stamping ...That's the reason I am thinking of switching company !

                          It appears that company B is not exactly being honest with you. Company A is your best choice; they likely are being affected by the economy and haveo positions open at this time.

                          Do you want to be sitting in the US with no job and no income? Half a million people have lost their jobs so far this year.

                            I suppose I should wait for company A to get the visa stamped...
                            I was getting restless as the wait for stamping has been going on from the day of the lottery draw.

                            So, thought of changing company if required ....

                              you must have to enter into USA , and H1B transfer is not possible before 1st oct 2008, Are you in USA with H1B stamp or you still not applied for VISA? and as per my knowledge you visa stamp will possible only through first employer. after 1st oct, you can change you employer after entering to USA.
