I am in the US, working for my employer who has got my H1B visa filed. It has been about 2 months since I have come to US. My employer has not yet given me a single pay stub, because I had not got a project. I have got it now, so he says he will pay me in the next month or so.
My question is:
1) I think it is unlawful that am employer does not pay the employee(irrespective of him being or not being on a project). Is it true? If yes, can I take some action against my employer, without harming my own visa status?
2) If I plan to transfer my visa, can it be done without pay stubs? Are there any possibilities for it?
3) If the answer to the above question is NO, then do I need one pay stub, or two pay stubs to get a visa transfer done?
I would be grateful if you could answer these questions.
