Applying for H4 while H1B is under review

My husband is on H1B and he got so many queries regarding his renewal. His attorney told him that chances are very less to get his renewal. Since his I-94 is already expired, he went to India this month 18th. Since he did not get his decision on H1B yet, can he apply for H4 visa in India? If he applies, how can he convince them that he applied for H4 as a precautionary measure? Or should he wait to apply for H4 until he gets decision on H1B? If he applies for H4, will the consulate refer back to his H1B status? Is that gonna be a problem? How long does it take to get his H4 visa?

No issues. Can apply for H4.
It takes same time as that of any other visa. H4 is nothing special.
