  • Appointment for H4 visa

    hi frenz..

    can somebody help me out in the regard asap.

    my visa has been expired in Dec 2007. But my husband got h-1b visa extension n his petition is valid till 3rd feb 2012. Even i got i-797 approval till feb 2012. I stayed in US for 2 yrs and came to india on dec 8th, 2009 n till today, my stay here has been 6 months. now my question is, while i am trying t block an appointment, i have two options:

    --Are u citizen of India??
    --Are u an indian citizen resident in the US???

    Which among the two options, i should opt???

    One more question is, bcoz i have i-797 form, will i come under visa renewal criteria (though my visa has been expired in 2007)??

    --are u applying for the same class of visa which is valid or that has been expired within last 12 months???yes or no

    pls help me out asap.

        hi shervin,

        becoz i stayed in india for more than 6 months, should i submit any supporting doc for my stay here in Andhra Pradesh during the interview???If yes, what is it n how should i get the supporting doc???

        Even my husband's visa is not renewed from 2007 and he is still in the US with i-797 with a validity till 2012. will that create a problem for my h4 stamping???

          >>> Just follow the documents listed here. If you have some address proof, then carry that.

          >>> Your husband's visa should not matter. As long as his petition and his I-94 are valid, his stay is legal and it would not cause any issues during your visa interview.
