H1 to F1 and I-130 Approved

Hi
I am currently on H1b and will expires in Oct 2010, My brother filled a petition for siblings 1-130 for immigration and is approved and priority dates is 0ct 2002,

1- Can I file change of status Now for Permanent Resident
2- Can I change my status from H1 to F1 as my Immigration petition is approved

if some one has any information kindly help me

Hello,

This page should give you information about adjusting your status which if you do an adjustment of status, you are considered in legal status. There shouldn't be a need to go from a H1 to an F1 because you can adjust the status. Please read the link below.

Thanks for your reply can you or any one tell me that my priority dates are not current like my Priority date is Oct. 20, 2002 but current processing dates are Jan 01, 2001 is it possible I can apply for AOS

If the priority date is not current, then you cannot apply for AOS.
