    Hi,

    My 12 month OPT is expiring on Dec 19, 2010 and I want to apply for H4 now.

    I know the mandatory docs that should be submitted with I-539, as mentioned in the instructions (passport, I94, husbands approved petition, marriage cert.). Apart from these should I submit any other documents?

    Like copies of all my I20s, EAD card and any proof that I was working on OPT till now? (I was volunteering for prof) Will they ask me proof that I have not been unemployed for more than 90 days?

    Has anyone applied for change of status from OPT to H4 and did the USCIS require any specific documents. Kindly, please please help me with list of docs I should send.

      Hi,

      Thanks for the reply. I will be applying from within the US since I am still on my OPT.

      One more question I have is about a question on the form I-539:

      3g.) Have you or any other person included in this application, been employed in the United States since last admitted or granted an extension or change of Status?"

      I want to know if assistantship during master's and CPT (full-time co-op) count as employment? Also, does volunteering during OPT count as employment?

      Would greatly appreciate any help in this regard. Thanks in advance.

        I think the answer in your case is Yes on the employment related question. Legit volumteering is not considered employment.

          Thanks. So you are saying that CPT and Assistantship (Quarter-time) count as employment?
