H1-B extension premium processing
My H1-B visa is about to expire.My company has applied for extension in normal processing.They said they can upgrade it to premium processing only after getting the receipt number( which usually takes 4 weeks).Now my question is cant they really upgrade it to premium processing before they get receipt number?Can they upgrade it rightaway so i can even get the receipt number in 2-3 days ?.Please HELP.

They should have applied in premium in the first place. If they want to upgrade now, how will they let USCIS know which petition to be upgraded to premium without the receipt number? So they will have to wait for the receipt number to go with the upgrade.Not a legal advice. Use of this information is strictly at your own risk. -

No. The term upgrade means that USCIS already have a pending petition which they can upgrade. When there is no receipt, there is no record of the petition and so logically it cannot be "upgraded". You had 6 months to file the extension. You just waited till the last minute and now you can't even wait for 2 more weeks to get the receipt notice.

i have to sponsor my mother-in-laws visitor visa .Can she attend interview without my visa extension receipt? If yes, In letter to consulate i have mentioned that she will be staying in my home for her entire stay,is it ok?Or do I have to resend another saying i will just provide funds.Comment
