  • H4 visa for my kid..Need Help

I am in us for 4 months & my husband & my 18 months kid was in India. My husband can not come to us for next 6 months as he does not have leave.
So now I am going for H4 visa for only my kid next week.

    I have the following questions

Will they ask my marriage certificate, if I have applying H1b only for my son?

What are the main documents needed?

Will they are anything about husband, like why he is not applying or coming with us?

    >>> No. Your son's birth certificate is required though.

    >>> They will not. Even if they ask, explain the same reason what you have posted here.

      Thankyou very much

One more question. I have only copies of my paystubs with now, also I don’t have my W2 or IT Returns yet. Its that ok. Apart from this I have other docs. I am just worried if this copies of my paystubs will work. Also How imp is to have bank statement ? Waiting for your reply.

      Thankyou again.

Copies of pay slips are enough. If you haven't received your W2 yet, then is okay (You can explain the same to the VO). It is better to carry the bank statements. They are not asked most of the times. But if asked, you should be in a position to show the bank statements as a secondary proof that you are paid properly as per the LCA.

            Hi OP,

I am assuming that your Husband is going with your son for his H4 Visa (as one parent should be present)....
Also if possible just give a covering Letter to your Husband (addressed to the Consulate) that you are approving that your son should be allowed for H4 visa and you will take care of him for all his needs/finance/stay etc as a parent/H1 holder.

This is just for a precaution - as "Child Protection" laws are strict in US and as your son is too young(cannot speak for himself) ----so consulate should know that both parents are approving/agree to his h4 visa.

Rest all documents as per the H4 check list.

            Thanks and regards,
            Abhay
