L2 Visa Application process for Spouse and kids

Hello there,

Could you please provide me the correct process for applying L2 visa for the spouse and kids.
Currently my status is L1A recently came to US one month ago, but my wife and 2 kids are in my country but planning to apply L2 from own country(Nepal).
But when I was checking application process, it says, needs to submit the documents, copy of I-129 and original notice of action (I-797) of the principal applicant.
Now, when I have inquired with the lawyer, he said needs to submit the I-824 form now I am confused what to do and which process is the right one?
Could you please assist me for the right direction to follow for L2 visa processing!!!

IMO 824 is for duplicate approval notice. When you got your Visa did you have the i-129 and approval notice? Why not just send that to your spouse.

Yes, When I got my visa I had my copy of I-129 and original approval notice along with me.
So, I don't need to apply for I-824 or duplicate approval notice????????

If I will send my those copies to my spouse, there is no other documents required to send from my side and would be sufficient major document to appear for interview?

Few more question:
1.)If I am in US since last month, can I submit my pay slips for only one month as I have spent only one month here in US?
2.)Do I need to send my SSN for an evidence while my wife goes for visa interview?
3.)Do I need to submit any tax related documents (IRS) for evidence?
4.) I have only photo copy of my I-129!! Is it ok to submit or you need original one? and, lastly
5.) Do you need to send the bank statement? as I have maintained my bank statement just for 1 month only so far!!!
Is it still ok or do not require at this stage?

PLEASE ADVISE ME!!!!!!!!!!!!!!!!!!!!

Hello There, once again!!!!!!!!!

Regarding my previous answer,
1. What will happen if I am not able to send my pay slips right now even for a month? as my boss have told me that the pay slip will not be possible this month because the project is still on but will be done by end of the month of February 2013 only, but my plan to submit the document by 10th of February.
2. If I will not send my pay slip just for one month,visa will be rejected on that base?
Please give me the satisfactory hope.

If you are not getting paid, you are not maintaining L1 status and your dependent may be denied the Visa.

Hello There,

My wife went for visa interview today at Kathmandu Embassy.
She was not asked so many questions from the VO, but a few questions like when did you get married? where does your husband live and what position he hold in US? just that...........
But he said there was technical problem with the system in his computer (as per my wife's statement), and he kept my original I-797 Approval Notice of Action, passport for my daughters and wife and asked to pay visa issuance fee to the next counter, and said to my wife, he will inform her when to collect passport and I-797 but generally they used to give the white ticket who have succeeded their interview to collect the passport after 2 business day.

Now, I want to make sure that,
1. Is my wife has been assured for visa or not?
2. They did not give any token or cheat for further admin processing.

Please make me clear on this situation.

Visa is not guaranteed until they get their passports back. But it seems highly likely that it will be approved. Sometimes there are additional checks and processing that the consulates do and they may be doing that. Unfortunately, there is no way of predicting how long it will take. Since the passports were kept by the consular officer, it is possible that it will not take a long time.

L1B Rejected for Spouse | Can apply L2

Hi Guys,

Im a L1B holder and presently in US for last 2 months. Now my wife also works in the same company and she applied for L1B visa. This was rejected last week.

My queries are:

1. Can she apply for dependent visa?
2. Does L1B rejection has an impact on dependent visa?
3. If Yes, how much do we need to wait before she applies for dependent visa.
