  • L1 A to H1 visa conversion regarding

    I am currently on L1 A visa from an X employer. My current employer X is not filing GC for me in EB-1 category though I am eligible. Another employer Y is interested in hiring me and offering me a Job. Hence I am trying to find what options do I have at this juncture?

    1. What is the process for converting L1 A to H1 visa?
    2. Can employer Y initiate GC process for me in EB-1 category while I am on L1-A visa for employer X?
    3. What alternatives do I have so employer Y can hire me directly?

    1. If it is fresh H1 then am afraid, H1 quota for this year is over the next year H1 cap season will begin only in April 2014 with start date of 01-Oct-2014. The earliest you can get on to H1 is 01-Oct-2014.
    The employer can file an H1 petition and a L1A to H1 COS next year April and you can start from Oct 2014.
    2. No only employer X can do so.
    3. Apart from H1 I dont see any other option.

    Another thing, on an H1 you most likely will not be eligible for EB1 unless you are someone with exceptional abilities. Do check your options.
